On the path to immigration, we have witnessed countless sudden policy changes. These events serve as recurring alarm bells, telling us a cruel reality without exception: the window for immigration will not remain open indefinitely, and hesitation and procrastination are the greatest enemies. Canada's immigration policy is undergoing a major transformation, and every policy adjustment acts as a new barrier on the road to Canada. Therefore, for those determined to immigrate to Canada, it is imperative to act quickly in the face of a narrowing immigration window, as opportunities are fleeting.
On August 6, 2024, the Canadian government announced a new policy for the Temporary Foreign Worker (TFW) Program and the Labour Market Impact Assessment (LMIA). The details are as follows:
1. A uniform 20% cap on the employment of temporary foreign workers will be implemented (the proportion of temporary foreign workers at the same employer and same work location must not exceed 20%), including LMIA applications that support both work permits and immigration intent. For dual-intent LMIA applications, employers will be subject to stricter requirements;
2. Strengthen oversight in high-risk sectors;
3. Increase LMIA application fees;
4. Amend regulations regarding employer eligibility, such as minimum years of operation or layoff history;
5. Consider suspending the processing of low-wage LMIA categories;
6. The TFW program is designing new application categories for agriculture, as well as fish and seafood processing.

The TFW program is designed to allow employers to hire foreign workers when they are truly unable to find suitable local Canadian residents, thereby filling gaps in the Canadian labor market. Employers can apply for an LMIA from the Department of Employment and Social Development. An approved LMIA can support foreign workers in applying for a Canadian closed work permit to work in a specific position for that employer, and can also provide additional points for Express Entry (EE) immigration. For the foreign worker being hired, an LMIA is highly significant; once obtained, it is almost equivalent to holding a ticket to immigrate to Canada. However, the implementation of the new LMIA policy means that future LMIA applications will become increasingly difficult, and the low-wage LMIA category may be suspended or significantly reduced, potentially becoming a thing of the past. It will be even harder to apply for "low-skilled" LMIA work permits to eventually obtain permanent residency (PR).
Every adjustment to Canada's immigration policy affects the hearts of countless applicants. In 2024, Canada's immigration policy has frequently "changed," from slashing work permits for international students to narrowing immigration pathways, catching many off guard. Applicants who need to apply for Canadian PR through an LMIA must seize the opportunity! Competition for Canadian immigration is becoming increasingly fierce, and now may be the final window to get on board. This new policy makes the review of LMIAs even stricter, and they will be harder to obtain in future applications! Regardless of the choice, timing and judgment are crucial.
The Canadian skilled worker employer-sponsored immigration program has a low threshold, very relaxed review, no investment amount requirements, no requirements for the applicant's previous work experience in the position, and lower requirements for language and education. Furthermore, the overall application cost is low, making it a very cost-effective immigration pathway with a simple, easy-to-operate application process and a high success rate! There are currently several ready-to-go LMIA positions available; they are first-come, first-served and worth seizing.
