As you may know, when immigrating to the U.S. through the EB-5 investment immigration program, applicants first receive a two-year valid "conditional green card (i.e., a temporary green card)," which is later converted into a ten-year permanent green card, signifying successful immigration to the U.S. So, what is the difference between a temporary green card and a permanent green card? What should you pay attention to after obtaining a two-year temporary green card? What conditions must be met to convert to a permanent green card? Please join WorldWay to find out.

There is no difference in the benefits and rights enjoyed by applicants between a temporary green card and a permanent green card. Upon receiving a temporary green card, the applicant and their family members can conduct business, work, and study within the U.S. as permanent residents. They can enjoy the same medical, pension, and other benefits as local residents, and their children can attend school in the U.S. as local students, enjoying free public education. The difference between the two is that the temporary green card is valid for 2 years, while the permanent green card must be renewed every 10 years.

For EB-5 investment immigration applicants, when the two-year temporary green card expires, the immigration authorities will conduct a qualification review of the investor. If the following 3 conditions are met, a permanent green card can be obtained: the investor has not withdrawn their investment within 2 years; the investment has created 10 jobs; and the investor has no criminal record within 2 years.

It should be noted that in addition to complying with local laws and regulations, temporary green card holders need to pay attention to the following three things.

Submit an application to remove conditions within 90 days before the temporary green card expires to obtain a permanent green card. Since the green card held at this time is conditional and only valid for 2 years, holders of temporary green cards obtained through investment immigration must submit an I-829 application to remove conditions within 90 days before the green card expires to obtain a ten-year unconditional green card. If the appropriate application is not submitted within the specified time, the temporary green card will automatically expire on the expiration date.

Temporary green card holders need to be careful to avoid leaving the U.S. for extended periods. Like permanent green card holders, if a temporary green card holder leaves the U.S. for more than 180 days but less than one year in a single trip, they will need to undergo a comprehensive entry inspection upon their next entry into the U.S.; if a temporary green card holder leaves the U.S. for more than one year in a single trip, customs officers may consider that they have abandoned their intention to reside permanently in the U.S. upon re-entry, thereby losing their green card status.

File taxes on time every year (including federal and state taxes). Once a temporary green card is obtained, regardless of where the green card holder resides, they are a legal permanent resident of the U.S., which means they will report their global income to the U.S. and pay corresponding income taxes as a U.S. tax resident. From a tax reporting perspective, the tax obligations of temporary and permanent green card holders are the same.

As a traditional major immigration destination, the U.S. is highly favored by high-net-worth individuals in the field of status planning and is the preferred choice for the vast majority of immigration applicants. Among the many ways to immigrate to the U.S., the EB-5 investment immigration program has always been an important channel for investors to obtain a U.S. green card. The U.S. EB-5 investment immigration program has relaxed conditions, with no restrictions on age, education, language, business, or work experience background. One person applies, and the whole family immigrates to the U.S., where they can live and work anywhere in the U.S., children enjoy free public education (K-12), and spouses and unmarried children under 21 can immigrate together.

Currently, the popular "Florida Lakefront Jewish Community" EB-5 rural project on the market provides Chinese investors with an excellent opportunity to quickly obtain a U.S. green card! This project is a rural TEA project that complies with the new act, featuring no visa backlog, a project employment multiplier as high as 5.44, and the EB-5 capital enjoying a first-priority mortgage guarantee. Furthermore, the project is supported by $51.4 million in infrastructure funds from the U.S. government. A dedicated website, https://lakefrontestatescdd.org/, has been set up for investors to check information on the source of funds. Market demand for the project is strong, and all residential units in Phase I have been sold out. This is a rare, high-quality rural EB-5 project. After round after round of purchasing, the remaining quotas are becoming fewer and fewer. Good projects do not wait; those interested should subscribe quickly!
