On July 12, the U.S. Citizenship and Immigration Services announced good news: the agency released a new I-526 form. This means that new EB-5 applications can be officially submitted starting today, marking the official resumption of EB-5 investment immigration!
The updated I-526 has two versions: the I-526 and the I-526E forms. Direct investment projects will use the new I-526 form, while regional center projects will use the I-526E form.
For new investors in EB-5 regional center projects, a detailed comparison of the new I-526 form reveals that the original version contained information on the source of EB-5 investment funds and the investor's net worth. The additional information is as follows:
l Receipt number for the project pre-approval I-956F form must be submitted
All past work experience history must be filled out
More detailed information on the source of investment funds
Dates and amounts of investment fund transfers or expected transfers
Dates and amounts of administrative fees related to the investment
An option to submit I-485, I-131, and I-765 concurrently with the I-526 application has been added
Honest Q&A for participants in regional center projects has been added
Questions regarding whether the investment in the regional center is related to foreign government entities have been added
The application fee remains unchanged compared to the I-526 form, still at $3,675. Each investor submitting the I-526E application for the first time must also pay a separate $85 biometric service fee. Additionally, the U.S. Citizenship and Immigration Services has stipulated on its official website that if an investor submits the I-526E form on or after October 1, 2022, they will need to pay an additional $1,000 in accordance with the requirements of the EB-5 Reform and Integrity Act of 2022.
Although many details of how the new law will be implemented still need to be clarified by the immigration agency, the release of the new I-526 form signifies the official resumption of EB-5 investment immigration. For new EB-5 applicants, the competition for no wait time slots has already begun, and interested investors need to act quickly!
Previously, the new U.S. EB-5 law allocated visa quotas, with 10% reserved for projects in high-unemployment areas (TEA), which enjoy reserved visa quotas. Furthermore, according to the new EB-5 immigrant visa bulletin released by the U.S. Department of State's Visa Office, the 10% reserved for high-unemployment area projects under the new regulations currently remains in a no wait time status! For EB-5 investors with plans to move to the U.S. quickly, seizing the no wait time slots means seizing the opportunity for success!
Currently, the two most popular EB-5 projects on the market comply with the new law's high-unemployment area (TEA) requirements, enjoying a 10% reserved visa quota, helping investors quickly secure a no wait time "first train" to obtain a U.S. green card! Investors can start with an investment of $800,000, and one application allows the entire family to immigrate to the U.S. quickly.
One project is located in Oakland, in the San Francisco Bay Area of California, with a 39-story apartment building containing 452 units. Currently, the project is 50% completed and is progressing steadily according to plan, with an expected completion date at the end of 2023. This project has multiple advantages, such as having received I-924 approval; previous investors have successfully obtained I-526 approval; ample job creation, with reports estimating that each investor can expect approximately 19.9 jobs, far exceeding the immigration agency's requirements; the project is developed and managed by a world-renowned developer with extensive EB-5 project experience; and the project has multiple guarantees, including 100% equity pledge from the developer and protection against I-526 denials.
The second project is located in the Arts District of the Dallas Central Business District in Texas, situated in a region with high economic growth in the U.S., characterized by strong market demand and numerous advantages, making it highly favored by investors. This project has a global limit of only 45 seats, and there are not many slots left, so interested parties should act quickly.
Good projects do not wait for anyone. For investors with a strong need to immigrate to the U.S., do not hesitate; apply early to benefit early, prioritize obtaining a green card, and start your American journey.
