Recently, Charles Oppenheim, Chief of the Visa Control and Reporting Division at the U.S. Department of State, was invited to attend the "EB-5 Advocacy Conference" organized by IIUSA. During the meeting, Charles Oppenheim provided a forward-looking forecast for the EB-5 annual visa quota for the new 2021 fiscal year (October 2020 to September 2021).
The annual visa quota for employment-based (EB) immigration for fiscal year 2021 will receive an additional 60,000 visas on top of the usual 140,000, bringing the total quota to over 200,000. These additional visas primarily come from unused visas in the F-category (family-sponsored immigration) from fiscal year 2020. As a result, the EB-5 category, which accounts for 7.1% of the annual employment-based visa quota, will have access to 14,200 visas in fiscal year 2021, representing a 42% increase over the standard annual quota of approximately 10,000. Furthermore, as the visas issued under the Chinese Student Protection Act for fiscal year 2020 will be fully repaid, there will be no need to deduct approximately 700 visas from the quota for EB-5 investors born in mainland China starting in fiscal year 2021.
Benefiting from this positive news, the visa quota available to applicants from mainland China has increased significantly, which undoubtedly boosts confidence that the EB-5 visa backlog for mainland Chinese applicants will gradually ease.
In fact, the EB-5 visa backlog for mainland Chinese applicants is currently accelerating across the board. The backlog for mainland Chinese investors experienced two major leaps in March and May; in March, the EB-5 Final Action Date (Table A) advanced by 5.5 months, and the Date for Filing (Table B) advanced by 7 months. In May, the EB-5 Final Action Date (Table A) advanced by 47 days. The EB-5 visa backlog for mainland Chinese investors continued to make steady progress in June and July, with the Final Action Date (Table A) advancing by 14 days in June and 7 days in July. Compared to the average advancement of one week per month over the past few years, a large number of investors will be able to land in the United States approximately two years earlier than previously predicted, providing a turning point for many children who were at risk of aging out.
