In what ways did the Chicago Conference Center project team commit fraud? According to the complaint filed by the U.S. Securities and Exchange Commission on February 6, it was revealed that the Chicago Conference Center project team deceived and misled EB-5 immigrant investors and the immigration bureau in the following seven aspects:

  1. There were false representations and fraud regarding the cooperation agreements with Starwood Hotels, Intercontinental Hotels, and Hyatt Hotels. The cooperation agreements with Starwood and Intercontinental were terminated in 2009 and 2010 respectively, and the cooperation agreement with Hyatt was entirely fabricated.

  2. The project team falsely stated that they had obtained project construction permits without actually securing formal construction permits in Chicago.

  3. The land valuation injected into the project was severely inflated. The 2.8 acres of land purchased for less than $10 million in 2008 was valued at $177 million as an equity contribution to the project, and to avoid taxes, this parcel was previously valued at $600,000. The SEC document mentioned that in 2011, a 20-acre parcel with basic facilities near the conference center was sold for only $7.7 million.

  4. There were false descriptions of Mr. Sethi and the developer's qualifications. It was falsely stated that 29-year-old Mr. Sethi had over 15 years of real estate development and management experience, particularly in the hotel industry, and that the developer, established only in 2010, had 35 years of industry experience.

  5. The offering documents falsely fabricated that approximately $340 million in support would be obtained from the Illinois state government, and when the immigration bureau requested additional documentation (RFE), they provided forged supporting documents to the immigration bureau.

  6. The offering documents promised a refund of the offering fee if the I-526 was not approved. Mr. Sethi misappropriated the majority of the $11 million management offering fee without the I-526 approval (of which $2.5 million was directly transferred to Mr. Sethi's private account in Hong Kong), leaving less than $1 million in the offering fee account.

  7. The employment estimates were based on inflated capital expenditure budgets and unrealistic revenue projections, making it difficult to achieve the projected employment. The Chicago Conference Center estimated hotel construction costs at $740,000 per room, and when including land costs, the cost per room approached $920,000. This far exceeds the average cost range of $210,000 to $610,000 per room in the United States. The hotel revenue forecast was based on the assumption of 100% occupancy for 995 hotel rooms throughout the year, with an average nightly rate of nearly $300, which is highly unrealistic.

Why would the governor of Illinois attend the project launch?

In fact, this was also a carefully woven scam by the project team. They took advantage of the governor's delegation visiting China to invite the governor and state senators to attend a press conference for a so-called investment project that could create 8,493 jobs, launching the project together with us. They exploited our trust in the governor and the state government to create the illusion of government support, thereby deceiving Chinese immigration intermediaries and investors. Subsequently, we learned from the U.S. side that the Illinois state government strictly prohibited the Chicago Conference Center project team from promoting the project using the governor's name or official insignia.

How many Chicago Conference Center clients of WorldWay Immigration were affected?

The project director of WorldWay Immigration stated: None of WorldWay Immigration's clients invested in the Chicago Conference Center. After discovering the issues, WorldWay Immigration terminated its cooperation with the project team and required all subsidiaries to promptly inform clients of the situation with a high sense of responsibility. Our sincerity was understood and supported by our clients, and without exception, all clients transferred to other EB-5 projects.
