Recently, the EB-5 Committee of the American Immigration Lawyers Association submitted a letter to Congress, proposing eight solutions to the EB-5 backlog issue. Meanwhile, the highly anticipated EB-5 Regional Center Program is set to expire on September 30. What will be the future of EB-5 policy? Can the EB-5 backlog truly be resolved?
WorldWay Immigration Group will soon provide an in-depth analysis of the latest trends in EB-5, partnering with top U.S. immigration law firms to explore solutions to the EB-5 backlog and forecast future trends, guiding investors through the process. Stay tuned!
What is the EB-5 backlog?
When the EB-5 visa cap is reached, the U.S. Department of State must retroactively establish a "cut-off date" based on the number of approved I-526 investors according to the current fiscal year's visa quota, prioritizing the issuance of EB-5 visas to applicants whose "priority dates" are earlier than the "cut-off date."
Thus, the waiting period (EB-5 backlog) for approved I-526 investors is the time during which the "cut-off date" in the visa bulletin is later than their "priority date."
How does the backlog affect investors?
In the May 2015 visa bulletin released by the U.S. Citizenship and Immigration Services, EB-5 investors from mainland China were surprised to find a backlog.
According to U.S. immigration law, unmarried children under the age of 21 can apply with their parents. The emergence of the EB-5 backlog poses a risk of aging out for children who are dependent applicants when they arrive in the U.S. at age 21.
Can the backlog be resolved? Is an increase in EB-5 investment fees imminent?
WorldWay Immigration Group has published an article titled "Tracking the Latest Developments in EB-5 Reform: Detailed Analysis of Eight Solutions to Resolve the Backlog" (click to learn more), providing guidance for investors seeking to immigrate to the U.S.
Additionally, the latest EB-5 draft legislation proposes converting 10,000 visa applications into 10,000 family quotas, making the resolution of the backlog a possibility, and emphasizes that a compromise between urban and rural factions in Congress is likely, with an increase in EB-5 fees on the horizon.
