Recently, many investors have been asking the same question: Is it still too late to start an EB-5 investment immigration process?
The answer is: It is not too late, but the window is rapidly narrowing.

The grandfathering provision countdown:
A critical juncture for locking in certainty
The core focus for EB-5 currently is the grandfathering provision. According to the EB-5 Reform and Integrity Act of 2022, as long as an investor files their I-526E petition before September 30, 2026, their application will continue to be processed under the rules in effect at the time of filing, even if EB-5 laws change in the future.
This is not just a deadline; it is a valuable window to lock in policy certainty. Once missed, investors will face multiple uncertainties.

Beyond the grandfathering provision,
be wary of two realistic pressures
The grandfathering provision is the core policy window for EB-5 at present; however, there are two other unavoidable realistic pressures that are continuously compressing the time investors have to make decisions.
First, the increase in investment thresholds: According to the Act, the investment amount will be adjusted based on the inflation index. It is widely predicted in the industry that starting January 1, 2027, the minimum investment amount for Targeted Employment Areas (TEAs) may increase from the current $800,000 to $900,000 or more. This means that the later you start, the higher the future entry threshold and overall capital costs may become.
Second, visa retrogression risk: Currently, there is no official visa retrogression for reserved visa categories such as rural areas, but the volume of applications continues to rise, and the risk of retrogression is accumulating. Once retrogression occurs, applicants already in the U.S. will be unable to enjoy the convenience of "concurrent filing" (filing Form I-526E and Form I-485 simultaneously), which provides benefits such as Employment Authorization Documents (EAD) and Advance Parole.
In other words, the grandfathering provision addresses the issue of "rule locking," while the increase in investment amounts and the risk of retrogression correspond to the issues of "rising costs" and "extended application cycles."
The coexistence of these three factors clearly indicates: The time left for investors to make a measured decision regarding EB-5 is running out.
The real risk:
Hesitation leads to being "too late"
Many investors are prone to the illusion that: "There is still time before September 30, 2026, so I can wait and see."
But the reality is that EB-5 is not an application that can be easily completed as the deadline approaches. From the formal start to the completion of the filing, there are multiple critical steps involved.
Starting with the end in mind and working backward, for families who have seriously considered EB-5, the most important thing now is not to continue waiting, but to enter the preparation stage as soon as possible. The earlier you start, the more time you can reserve for document preparation, capital verification, and legal review.
Who needs to act immediately?
The following groups of people should pay particular attention to the current EB-5 window:
• Families with children's education plans: To avoid children losing their eligibility as derivative applicants due to turning 21 (the "aging-out risk"), it is essential to lock in the priority date as early as possible.
• Individuals in the U.S. seeking status autonomy: For international students who have failed to secure an H-1B visa multiple times, whose OPT is about to expire, or for professionals who wish to break free from employer constraints, EB-5 provides a valuable path to decouple their status from their employment.
• High-net-worth individuals conducting global asset allocation: For high-net-worth families looking to simultaneously plan their status, assets, education, and tax arrangements, the current window offers significant value in terms of certainty. The earlier you start, the easier it is to make your overall planning more relaxed.
• Individuals with clear relocation or contingency needs: For those planning to move to the U.S. in the future, or who wish to establish a reliable "safety net" for themselves and their families, now is an optimal time to act.
On the path of immigration planning, there is no more dangerous idea than "wait and see." The reality is that the policy window will not wait for anyone, and high-quality projects will not hold spots indefinitely. The earlier you act, the more initiative you can maintain, winning valuable certainty and options for your family's future.

WorldWay holds two high-quality rural EB-5 projects with official I-956F approvals——"North Carolina Sugar Mountain Hilton Hotel" and "Great Smoky Mountains Marriott Hotel", helping investors achieve their U.S. status planning securely, efficiently, and without retrogression, quickly embarking on a new life in the United States.
