September 30, 2026, is the date that will determine whether you can still lock in your path to U.S. immigration.
This critical juncture is quietly approaching as time passes.
For EB-5 investment immigration, this certainty is not a subjective judgment, but is clearly written into law—its name is the "Grandfather Clause."
However, this policy protection lock prepared for investors has already been clearly marked with an expiration date. The actual window remaining for applicants to prepare and complete their filings has entered its final countdown stage.

What is the EB-5 Grandfather Clause?
Why is it so important?
The current EB-5 program was reauthorized in 2022, and the EB-5 Reform and Integrity Act explicitly includes a "Grandfather Clause." This clause stipulates that all EB-5 applications submitted before September 30, 2026, will not be affected by future changes in law and policy and will continue to be adjudicated under the current rules.
For this reason, the Grandfather Clause is widely regarded in the industry as an essential safeguard mechanism for locking in policy certainty within the EB-5 investment immigration system.
Why is "not acting now" actually high-risk?
Many applicants see the date "September 30, 2026" and often mistakenly believe that there is "plenty of time left." However, in the EB-5 system, this is the most dangerous judgment to make.
1. Filings often surge as the deadline approaches.
Historical experience shows that with every policy milestone, EB-5 applications tend to be submitted in large volumes over a short period. As the expiration date of the Grandfather Clause approaches, legal, regional center, and documentation resources are quickly exhausted, project quotas tighten, and the pace of filing slows significantly. The true effective window often closes months before the nominal date.
2. A difference of a few days in priority dates can result in a vast difference in visa retrogression.
The EB-5 priority date is determined by the official I-526E filing date, which directly dictates the position in the visa queue. For major source countries like China and India, even a delay of a few days in filing can lead to a significant gap in future retrogression. More realistically, although the current reserved visa categories remain current, it is only a matter of time before retrogression occurs as application volumes rise. By the time retrogression is "officially written into the Visa Bulletin," it is often already too late.
3. The EB-5 program is not a project where you can "decide today and file tomorrow."
In practice, the vast majority of applicants underestimate the actual time required for an EB-5 application. The entire process is not a simple "make a decision and file immediately" scenario; rather, it is an interconnected preparation process. From initiation and financial planning to document preparation and final successful submission, every step requires sufficient time for refinement.
The threshold of the Grandfather Clause is "successful submission," not "start preparing." Only when the submission is completed does the policy protection truly take effect.
What are you actually losing if you miss the Grandfather Clause?
Many people see only "a date" and overlook what it entails. Once missed:
• Policy protection disappears: New applications will be fully exposed to future changes in law.
• Potential increase in investment thresholds: Under the new law, future investment amounts will be adjusted every five years based on the U.S. Consumer Price Index (CPI). The next adjustment will occur on January 1, 2027, and it is expected that the minimum investment amount for TEA projects may increase from $800,000 to $900,000 or even higher.
• Once retrogression occurs in the new EB-5 reserved visa categories, the current golden window of "no retrogression + concurrent filing" will end.

2026 is a critical turning point for EB-5.
In the current environment of tightening U.S. immigration policies, EB-5 remains one of the few immigration channels with a clear legal basis, a well-defined path, and transparent rules.
The Grandfather Clause is the only protection mechanism in this channel with a clearly marked "expiration date."
• File now: Lock in the rules, lock in the threshold, and lock in the policy environment.
• Hesitate: Face the cumulative risks of price increases, retrogression, and policy uncertainty.
Rational planning is never about gambling on policy; it is about locking in risks before the window closes.
The countdown has begun. The only thing left is the choice to act.
