In recent months, there has been a prevailing expectation in the market regarding the "$100,000 H-1B application fee": Will it be halted? Will it be postponed? Will it be overturned in court?

However, the answer has now been delivered, and it is very clear.

The U.S. Federal Court has officially ruled: The $100,000 H-1B application fee introduced by the Trump administration is in compliance with the current legal framework and is valid. The joint lawsuit led by U.S. business groups and technology companies has been dismissed.

The Court's Stance:

It does not judge right or wrong, only reviews authority.

The core of this case is not whether the fee is "expensive," but whether the President has the authority to do this.

The judge responsible for the ruling clearly pointed out in the judgment:

Whether the policy is wise is a political judgment, not a matter of judicial authority.

As long as the President's decision is in compliance with the current legal framework, the court must uphold it.

In other words, the court is not concerned with whether this policy will provoke a backlash from businesses or affect labor costs, but only confirms one thing: whether the President's discretion in immigration matters has a legal basis.

The conclusion is: it does.

The H-1B Program is Systematically Narrowing

For a long time, the H-1B visa has been regarded as an important tool for U.S. companies to bring in specialized foreign talent. The program offers 65,000 regular slots each year and an additional 20,000 slots for applicants with advanced degrees, with the technology sector being particularly reliant on it.

The new policy, under certain circumstances, raises the direct cost of a single application to $100,000, fundamentally changing companies' cost expectations and usage logic regarding this visa.

More importantly, this is not an isolated event. On December 23, 2025, the U.S. Department of Homeland Security (DHS) and the U.S. Citizenship and Immigration Services (USCIS) officially confirmed that the H-1B visa will shift from the long-standing random lottery system to a new mechanism weighted by wage levels. The upcoming lottery in March will fully apply the wage-weighted lottery rules.

At the same time, starting from December 15, 2025, the U.S. Department of State will expand the "online presence review" to all H-1B and H-4 applicants, significantly increasing compliance requirements. Several tech giants (including Google and Apple) have already issued reminders to their internal employees, advising H-1B visa holders to be cautious when leaving the country, as returning to the U.S. may be delayed by up to a year!

The Traditional Path for International Students to Stay in the U.S. is Failing

If the "wage weighting" changes the distribution rules, then the "$100,000 fee" alters the decision-making mechanism for companies. When these two factors overlap, their impact is no longer a localized adjustment but a systematic reconstruction of the pathways for international students and foreign professionals to remain in the U.S.:

• The probability of selection is no longer primarily dependent on luck, but on job value and salary level.

• Companies will no longer "give it a try," but must complete a rigorous cost-benefit assessment before submitting an application.

• The H-1B is returning to its original positioning: serving only a few "irreplaceable" positions and individuals.

For a large number of international students, this means a real change: the traditional H-1B pathway, which relied on time and probability, is losing stability. The previously validated pathway—study abroad → OPT → lottery → H-1B → waiting for a green card—is becoming increasingly unviable.

The Fluctuations in H-1B Policy are Intensifying

Certainty in Identity Pathways is Gaining Attention

In this context, more and more families are beginning to reassess another completely different identity pathway—EB-5 investment immigration.

Compared to the uncertainty of the H-1B, the advantage of EB-5 lies in its certainty.

• It is not an administrative measure, but written into law: The EB-5 program was established by Congress in 1990, with a complete policy framework and clear operational mechanisms. More importantly, in the reform bill of 2022, EB-5 was explicitly reauthorized and written into law.

• Economic contribution: EB-5 investment immigration allows foreign investors to obtain U.S. residency through compliant investments in U.S. projects, with a minimum investment of $800,000, and must create at least 10 jobs. For over 30 years, this program has attracted hundreds of billions of dollars in foreign investment, becoming an important driving force for U.S. economic development.

• Ample quotas: There are still sufficient visa quotas available, and rural EB-5 projects have a fast processing speed.

Additionally, the new EB-5 law has brought an unprecedented window period: rural EB-5 projects are exempt from waiting periods and have priority approval advantages; the "dual submission" policy allows applicants to submit I-526E and I-485 simultaneously in the U.S., obtaining a Combo Card in about three months, quickly achieving legal residency and employment eligibility.

WorldWay holds two high-quality rural EB-5 projects, assisting investors in safely, efficiently, and without waiting periods to achieve U.S. identity planning and quickly embark on a new life in the U.S. Global quotas are limited, and seats are scarce; first come, first served!
