Focus on Bissau investment immigration and relevant laws in Guinea: Special provisions for fixed-term employment contracts in Guinea.
Article 1: A fixed-term employment contract refers to a contract with a specific duration, which is generally determined at the time of signing.
Article 2: Employers and employees have the right to sign fixed-term contracts at any time, provided that the contract duration does not exceed two years. Contracts exceeding this period are considered "indefinite-term contracts."
Contracts with a duration of less than two years may be renewed, but the renewal period must not exceed the duration of the initial contract, and the combined duration of the two contracts must not exceed two years.
Any renewal contract that does not comply with this provision shall be deemed an indefinite-term contract.
Article 3: In the following circumstances, a fixed-term employment contract may be signed without a specified duration:
——When the contract is signed due to staff replacement, construction, the need for temporary additional personnel for a specific task, or temporary business activities.
——In any case, the contract must be in writing; otherwise, it shall be deemed an indefinite-term contract.
Article 4: If a fixed-term contract expires without renewal, but the employment relationship continues between the employer and the employee, the employee may request to enjoy the preferential conditions stipulated by the terms of an indefinite-term contract.
