In the current context of international education, more and more parents are choosing to send their children abroad for studies. However, what many do not know is that students without legal status often face unfair treatment. For families with a need to study in the United States, obtaining a U.S. green card for their children opens up more possibilities for their future.
The second round of the H-1B lottery for the fiscal year 2025 officially ended on August 5. In this second round, the immigration bureau selected 13,607 beneficiaries from a total of 14,534 valid registrations. After the second round of "fishing," the total number of selected individuals for the fiscal year 2025 H-1B reached 135,137. The immigration bureau stated that the total selected after two rounds of lottery can meet the annual quota limit.
Additionally, the second round of the lottery included both bachelor's and master's degrees, meaning that theoretically, those with master's degrees do not have a higher chance of selection. Furthermore, the decrease in application rates for the H-1B cap petitions for the fiscal year 2024 and the reduction in registrations for the fiscal year 2025 indicate that the "one person, one draw" system may have had an effective impact.
However, recently Bloomberg's lawsuit against the Department of Homeland Security revealed astonishing H-1B data. Bloomberg's report indicated that between 2020 and 2023, many human resources companies engaged in large-scale cheating by submitting multiple registrations for the same employee ("one person, multiple draws"). These companies hired poorly qualified employees at low salaries and, after selection, rented them out to other companies with actual business needs, profiting by taking 20%-30% of the employee's salary. It is estimated that last year about 15,500 visas, or one in every six visas, were obtained through this method. This year, the H-1B lottery rules have been changed so that a beneficiary can only occupy one lottery slot, curbing the abuse of the H-1B program. The immigration bureau has confirmed the revocation of H-1B visas involved in fraud and is conducting criminal investigations into certain cases. However, Bloomberg stated that while the immigration bureau can revoke visas on a case-by-case basis, it cannot prevent companies from participating in the H-1B lottery. Some companies that abuse the H-1B program can still participate in the annual lottery.
The H-1B visa, as the primary pathway for applying for work visas (including international students) to legally stay in the United States, has become increasingly competitive, and for a long time, there have been "more monks than porridge." Even if one is fortunate enough to be selected, they still face the challenge of how to resolve their long-term status in the United States. The low selection rate for H-1B visas, combined with the increasing number of applications each year, naturally lowers the probability of obtaining status through the lottery. Therefore, for many applicants, it is advisable to prepare a Plan B early to facilitate their stay in the United States.
For families whose children are already studying in the United States or those planning to study in the United States, if they wish to stay in the U.S. for work and life without being troubled by the H-1B visa, parents of international students may consider early planning: obtaining a green card for their children allows them to study and stay! For example, preparing a U.S. green card for their children through the EB-5 investment immigration program is a reassuring option for families, enhancing the success rate of their children's applications to prestigious schools and ensuring a stable future. After graduation, children will no longer be trapped in OPT and H-1B, having more quality choices and fair opportunities in internships and employment.
"Parents love their children, so they plan for them far ahead." By planning for their status in advance, parents can alleviate their children's worries. Currently, it is an excellent time to plan for children's status through EB-5 investment immigration. After the implementation of the new EB-5 investment immigration policy in the United States, applicants can conduct "dual submission" in the U.S., meaning that applicants without a waiting period can simultaneously submit the I-526E immigration application and the I-485 adjustment of status application, and can also apply for travel permission I-131 and work permission I-765, allowing them to legally reside, study, and work in the U.S., enjoying the freedom of a quasi-green card in advance.
Since the new law was enacted, many clients of WorldWay Immigration have quickly obtained a 5-year Combo Card (also known as the "little green card") through dual submission, with the fastest processing time being only 3 months, effectively resolving their legal status in the United States.
Since the release of the new EB-5 law in the United States, it has been well received by Chinese families. The "EB-5 rural project under the reserved visa category—no waiting period & dual submission & priority approval" has become a focal point for many families. Faced with this rare opportunity, many applicants have acted quickly to seize the valuable chance for rapid immigration to the United States. If you are also interested in immigrating to the United States, be sure to act quickly, seize the opportunity, apply early, get approved early, and benefit early!
