Recently, positive news regarding U.S. investment immigration has been emerging frequently. For the first time, USCIS has clarified that legacy investors who filed their I-526 petitions before the new act can also utilize concurrent filing. This means that if a legacy investor's I-526 is still pending, and while their priority date has not yet been reached under Table A, it has been reached under Table B (provided that Table B is open), the investor may file an I-485 for adjustment of status, along with applications for work and travel authorization, if they are currently in the United States under another legal status. If the investor's priority date has already been reached under Table A, they are in the same position as investors under the new act who are exempt from visa retrogression and may file an I-485 directly.
Furthermore, another piece of great news is that the validity period of the Advance Parole (AP) card has been extended to 5 years. Previously, USCIS announced that it would extend the validity of initial and renewal Employment Authorization Documents (EAD) for certain applicants to a maximum of 5 years. At that time, we speculated that the validity of the AP card might also be adjusted accordingly. Recently, this speculation was confirmed, as some investors have already received 5-year AP cards.
The EAD card, or Employment Authorization Document, is a work permit. Holding an EAD card means the holder has received permission from USCIS to work legally in the United States. The AP card, or Advance Parole, is issued to foreign nationals who do not have permanent resident status (a Green Card) in the United States, allowing them to leave and re-enter the country directly without a visa. When combined, they are known as a Combo card (also referred to as a "mini Green Card"). Once a Combo card is obtained, the holder can travel in and out of the United States freely and work and live without restrictions until the formal Green Card is approved.
In fact, as early as June 2021, USCIS had already extended the validity of EAD and AP cards to 2 years. Now, the validity has been further extended from 2 years to 5 years. This is excellent news for immigration applicants, providing further convenience for investors in terms of working, living, and studying in the United States.
It must be said that recently, USCIS has continuously brought good news to investors, making policies more efficient and user-friendly, facilitating the travel of investors to the United States.
Currently, it is an excellent time to immigrate to the United States. The new EB-5 act has shortened the investment period to 2 years and eliminated the need for future reinvestment. For investors, choosing a project with a "short investment cycle + visa retrogression exemption + concurrent filing + priority processing" will allow for faster immigration to the United States and flexible investment arrangements, truly enjoying the policy dividends. This is a once-in-a-lifetime opportunity, so act early! As the number of applicants increases, hesitation will cost you more than just money—it will cost you an irreplaceable opportunity!
Currently, the popular "Florida Lakeside Jewish Community" EB-5 project on the market has a minimum investment period of 3 years and is a rural TEA project under the new act. It combines many advantages such as visa retrogression exemption, priority processing by USCIS, a project employment multiplier as high as 5.75, and first-priority mortgage security for EB-5 funds, making it an optimal choice to help investors immigrate to the United States quickly!
