U.S. EB-5 Investment Immigration New Policy
Major Positive News is Here
The New EB-5 Immigration Investment Period is Shortened to 2 Years
On October 11, 2023, the U.S. Citizenship and Immigration Services (USCIS) announced a new policy regarding the minimum investment period under the new EB-5 law, shortening the investment period to 2 years. This is excellent news for EB-5 investors under the new law, as compared to the old law, the new regulations significantly reduce the investment duration and eliminate the need for future reinvestment.
At the same time, USCIS pointed out that the new EB-5 law only requires that the investment must last at least two years if the job creation requirement is met. Although the regulations do not specify when the two-year period begins, USCIS interprets the start date as the date the investor completes the qualifying investment. In other words, USCIS will consider the date the investment enters the NCE (New Commercial Enterprise) and is provided to the JCE (Job Creating Entity) as a date of at-risk investment, marking the start of the two-year investment period.
As we know, on March 15 of last year, the U.S. Congress enacted the EB-5 Reform and Integrity Act, referred to as the "EB-5 New Law." USCIS has clarified that investors who submit I-526 or I-526E (Regional Center Project Investment Application) on or after March 15 of last year must meet the investment time requirement of maintaining the investment for at least two years. USCIS believes that since the EB-5 New Law (RIA) has eliminated the requirement for EB-5 applicants to maintain their investment during the conditional green card period, new law investors only need to maintain their investment for at least two years. This change means that investors no longer need to maintain their investment for several years due to uncontrollable factors (such as visa backlogs).
Regarding whether the new investment period requirements apply to investors before the implementation of the new law, USCIS has clearly stated that the new investment period regulations only apply to new law investors, while investors before the implementation of the new law must still maintain at-risk investments during the two-year conditional green card period.
The U.S. EB-5 investment immigration program has been in existence for over 30 years since it was legislated by the U.S. Congress in 1990. The EB-5 Regional Center Program was restarted in March 2022, and a series of favorable policies have created a rare opportunity for investors to immigrate to the U.S. quickly. The new law allocates visa quotas, with high unemployment area (TEA) projects enjoying a 10% reserved visa quota, rural area (TEA) projects enjoying a 20% reserved visa quota, and infrastructure projects enjoying a 2% reserved visa quota. Investors meeting any of the "reserved visa" conditions do not need to wait for visa backlogs!
It is worth noting that rural TEA projects not only enjoy reserved visa quotas but will also receive priority processing from USCIS. Additionally, the new law allows eligible applicants to simultaneously submit I-526E/I-526 immigration applications and I-485 adjustment of status applications, as well as travel permit I-131 and work permit I-765 applications, enabling them to live and work in the U.S. more quickly.
Now that the EB-5 investment period has been shortened to 2 years, for investors, choosing projects with "short investment cycle + no backlog + dual submission + priority review" will facilitate faster immigration to the U.S. and allow for flexible investment arrangements, truly enjoying the benefits of the policy.
Immigration investment is all about choice; success comes from successful choices. Currently, the popular "Florida Lakeside Jewish Community" EB-5 project has a minimum investment period of 3 years, which complies with the new law's rural TEA project requirements, combining advantages such as no backlog, priority processing by USCIS, a job multiplier of up to 5.75, and first lien collateral for EB-5 funds, making it an excellent choice for investors to immigrate to the U.S. quickly!
