Recently, the U.S. Department of Homeland Security (DHS) announced a series of important measures, one of which is particularly significant for I-485 applicants. The information indicates that the U.S. Citizenship and Immigration Services (USCIS) will extend the validity period of the initial EAD work permits and renewal work permits for certain applicants to a maximum of 5 years, including those adjusting their status within the U.S. (adjustment of status). In fact, adjustment of status refers to I-485 applicants!
The purpose of this action by USCIS is straightforward: extending the validity period of the EAD can reduce the frequency of applicants needing to apply for work permit renewals, thereby effectively reducing the workload and processing time for USCIS. The manpower and time saved can be utilized for processing other applications.
EAD work permit, short for Employment Authorization Document, refers to a work permit document. Holding an EAD work permit means that the holder has received permission from USCIS to work legally in the United States. This means that applicants can work freely in the U.S. and travel in and out, both the applicant and their spouse can work legally, children can attend local public schools, and they can apply for local state government health insurance, enjoying most of the conveniences of life as U.S. residents.
As early as June 2021, USCIS had already extended the validity period of the EAD work permits during the I-485 phase from the original 1 year to the current 2 years. This time, USCIS may extend the current 2-year validity period to 5 years. This is great news for immigrant applicants. An extension to 5 years means that applicants waiting for I-485 approval (including those EB-5 applicants under the new law who can submit concurrently without a backlog) may receive a temporary green card without needing to renew their work permits.
As we know, last year, the U.S. Congress enacted the EB-5 Reform and Integrity Act, referred to as the "New EB-5 Act," which provides significant benefits for investors and their families. Investors can choose EB-5 visa reserved category projects to obtain U.S. green cards quickly without a backlog. Moreover, the new law allows eligible applicants to submit I-526E/I-526 immigrant petitions and I-485 adjustment of status applications, as well as travel permit I-131 and work permit I-765 applications simultaneously, potentially receiving a 5-year EAD work permit at once, thus enabling them to live and work in the U.S. more quickly.
Recently, there have been frequent positive news regarding U.S. immigration. Applicants interested in immigrating to the U.S. should act quickly to seize the opportunity of the "fast track" without a backlog to obtain a U.S. green card!
