Recently, the U.S. Citizenship and Immigration Services (USCIS) announced the employment-based immigration visa quotas for Fiscal Year 2024 (October 1, 2023, to September 30, 2024) in its employment-based visa Q&A section. For FY 2024, the total quota for employment-based immigration visa categories is 165,000, which is 25,000 more than the standard annual quota of 140,000.
Thanks to this, the EB-5 immigration category, which accounts for 7.1% of the annual employment-based visa quota, will have 11,715 visas available in FY 2024, an increase of approximately 1,715 visas compared to the standard annual quota of about 10,000.
According to the new act, the EB-5 visa set-aside categories for FY 2024 will receive 32% of the visa set-aside quota, totaling 3,749 visas (11,715 * 32%). However, the final total set-aside visa quota for the entire fiscal year should also include any unused set-aside visa quotas from FY 2023 (if any).
The number of EB-5 visas for FY 2024 is quite substantial. Additionally, it is worth noting that in the first month of the new FY 2024, investors born in mainland China continue to be in a non-backlog status for the EB-5 visa set-aside categories (20% for rural area projects, 10% for high unemployment area projects, and 2% for infrastructure projects).
Applicants interested in immigrating to the United States should act quickly to board the "fast track" and avoid backlogs to obtain a U.S. Green Card! Furthermore, the new EB-5 act allows eligible applicants to simultaneously file their I-526E/I-526 immigration petition and I-485 adjustment of status application, as well as applications for travel authorization (I-131) and employment authorization (I-765), enabling them to live and work in the United States sooner.
