The U.S. Department of State's Visa Office has officially released the Visa Bulletin for the first month of the 2024 fiscal year, October 2023, for EB-5 immigrant investor visas. The latest results show that for Table A, the C5 and T5 categories for direct investment projects, as well as the I5 and R5 non-reserved categories for regional center projects, have all advanced by 23 days compared to the previous month, reaching October 1, 2015. For Table B, the C5 and T5 categories for direct investment projects, as well as the I5 and R5 non-reserved categories for regional center projects, have all advanced by one year, reaching January 1, 2017.
It is worth noting that the EB-5 visa reserved categories (20% for rural projects, 10% for high-unemployment area projects, and 2% for infrastructure projects) currently remain current with no visa backlog.
Table A: Final Action Dates For Employment-Based Preference Cases
(Note: For Guangzhou Consulate interviews & USCIS I-485 Adjustment of Status applications)

Table B: Dates For Filing Of Employment-Based Visa Applications
(Note: For those legally residing in the U.S. who meet relevant conditions to file an AOS Adjustment of Status application with USCIS)

Furthermore, USCIS has officially announced that it will accept I-485 Adjustment of Status applications based on Table B for the month of October.

According to the October Visa Bulletin, the priority date for applicants born in mainland China for the non-reserved categories of EB-5 regional center projects is October 1, 2015. Investors who have received I-526 approval and have a priority date earlier than October 1, 2015, may proceed to the final Guangzhou Consulate interview stage or file an I-485 Adjustment of Status application in the United States. For investors who have received I-526 approval and have a priority date between October 1, 2015, and January 1, 2017, it is recommended to pay fees and submit Form DS-260 and supporting documents to the NVC for review as soon as possible to obtain a documentarily qualified letter. The NVC visa teams within the document and customer service departments of Worldway Group will, as always, initiate client screening, contact relevant law firms, submit NVC visa applications for eligible applicants, and provide interview coaching.
Worldway Tip: As you may know, as early as February 14 of this year, USCIS adjusted the age-out calculation rules for I-485 applications: the child's age will be locked based on Table B (provided that Table B is open; otherwise, it continues to be based on Table A). This time, Table B is open and has advanced by one year to January 1, 2017. Therefore, for families whose children have aged out under Table A but not under Table B (i.e., investors with priority dates between October 1, 2015, and January 1, 2017), please contact Worldway Group as soon as possible to confirm whether your children meet the relevant conditions to file an I-485 application and lock in their age.
Worldway Group will continue to provide clients with professional, high-quality, and efficient services. In fact, as a Top 500 Asian Brand with over 20 years of focus on investment immigration, Worldway Group has always practiced its "client-first" service philosophy through concrete actions, helping every investor realize their American Dream.
In addition, according to the October Visa Bulletin, the EB-5 reserved categories for investors born in mainland China remain current with no backlog. For investors, the current rural (TEA) projects enjoy reserved visa quotas and are in a no-backlog status, which will help investors immigrate to the United States quickly. Investors should act immediately to lock in reserved visa quotas in advance; the time to catch the "fast track" to immigrate to the United States without a backlog is now! At the same time, the new EB-5 Reform and Integrity Act allows eligible applicants to concurrently file an I-526E/I-526 immigrant petition and an I-485 Adjustment of Status application, as well as applications for travel authorization (I-131) and work authorization (I-765), thereby enabling them to live and work in the United States sooner.
There are two key elements to immigration—timing and choice! Currently, the popular "Florida Lakeside Jewish Community" EB-5 rural project on the market offers Chinese investors an excellent opportunity to quickly obtain a U.S. Green Card! This project is a rural TEA project that complies with the new act, combining many advantages such as no backlog, priority processing by USCIS, a project employment multiplier as high as 5.44, and first-priority mortgage security for EB-5 funds, making it a preferred choice for investors to immigrate to the United States quickly!
