EB-5 Immigration News: USCIS Relaxes Age-Locking Restrictions for Table B

Good news! The U.S. Citizenship and Immigration Services (USCIS) has recently updated its Policy Manual, designating the previous new policy on Table B age-locking as a special circumstance. Under this special circumstance, it is possible to grant a waiver to those children who were unable to file their I-485 applications and complete the "seek to acquire" action within one year due to policy changes.

Good news!

EB-5 Immigration News: USCIS Relaxes Age-Locking Restrictions for Table B

Previously, on February 14th of this year, USCIS adjusted the calculation rules for aging-out for I-485 applications: the age of the child would be locked according to Table B (provided that Table B is open; otherwise, it continues to follow Table A). In other words, USCIS shifted from using Table A to determine aging-out to using Table B. However, according to immigration regulations, the applicant (the child) must file an I-485 application within one year of Table B becoming current, which completes the "seek to acquire" action to truly finalize the age-lock. The beneficiaries at that time were families whose children's CSPA (Child Status Protection Act) age would have exceeded the limit under Table A but would remain within the limit under Table B.

For many families, before the new policy was released on February 14th, they had already seen that their children's ages did not meet the previous Table A age-locking requirements, or they missed the "seek to acquire" requirement of filing an I-485 within one year of Table B becoming current after the new policy was released, thus failing to qualify for the new Table B age-locking policy. How to satisfy the "seek to acquire" requirement became their greatest source of confusion. Just recently, USCIS made corresponding adjustments, which can be seen as responding to the calls from immigration groups.

This time, USCIS updated the Policy Manual, designating the February 14th Table B age-locking policy as a special circumstance. This means that in such special circumstances, children who were unable to file their I-485 applications and complete the "seek to acquire" action within one year of Table B becoming current due to policy changes can be exempted. Furthermore, there have already been actual approved cases: a child who had been determined to have aged-out by the U.S. Consulate and who insisted on filing an I-485 application after the February 14th new policy (despite not having filed within one year of Table B becoming current and not having met the "seek to acquire" condition at that time) has received approval.

This is a major surprise for investors. WorldWay Immigration kindly reminds all families whose children have aged-out under Table A but not under Table B that if they have not yet filed an I-485 application, please do so as soon as possible to secure more opportunities.

As everyone knows, as a traditional major country for immigration, the United States has always been an ideal destination for many due to its advanced medical technology, sound social welfare, superior natural environment, and top-tier education level. The U.S. Green Card is an identity card with high global value: it allows individuals to enjoy benefits stipulated by the U.S. government, access high-quality and thoughtful medical services, provide children with top-tier education in public schools, and offers the convenience of global mobility, among other benefits.

For a long time, the U.S. EB-5 investment immigration program has been an effective way to obtain a U.S. Green Card quickly. The application conditions are lenient, with no restrictions on age, education, language, business background, or work experience. One person applies, and the whole family immigrates to the United States. You can live and work anywhere in the U.S., children enjoy free public education (K-12), and spouses as well as unmarried children under 21 can immigrate together.

There are two key elements to immigration—timing and selection! Currently, the popular "Florida Lakeside Jewish Community" project on the market is a rural TEA project that complies with the new act. It not only enjoys reserved EB-5 visa quotas but also receives priority processing from USCIS. It combines many advantages such as being visa-exempt, having an employment multiplier as high as 5.44, and having the EB-5 project funds enjoy first-priority mortgage guarantees! Good projects do not wait; interested parties should act immediately!
