The U.S. Department of State's Visa Office has officially announced the immigration visa bulletin for the EB-5 investor visa for September 2023, which marks the twelfth month of the fiscal year 2023. The latest results indicate that the dates on Chart A remain unchanged, with the C5 and T5 categories for direct investment projects aligned with the non-visa reserved categories I5 and R5 for regional center projects, remaining at September 8, 2015. Chart B also remains unchanged, with the C5 and T5 categories matching the non-visa reserved I5 and R5 categories for regional center projects, staying at January 1, 2016.

It is noteworthy that the reserved categories for EB-5 visas (20% for rural area project reserved visas, 10% for high-unemployment area project reserved visas, 2% for infrastructure project reserved visas) currently have no priority date for investors born in mainland China. Applicants intending to immigrate to the United States are encouraged to act promptly and continue to take advantage of the expedited process that bypasses the priority date, allowing for a swift acquisition of a U.S. Green Card!

September EB-5 Visa Bulletin Released: No Priority Date for Reserved EB-5 Immigration Visas

According to the September visa bulletin, there remains no priority date for the reserved categories of EB-5 visas for investors born in mainland China. For investors, rural area (TEA) projects currently enjoy reserved visa quotas and remain without a priority date, which facilitates their immigration to the United States in a timely manner. Investors should take immediate action to secure reserved visa quotas and seize the opportunity to utilize the expedited immigration process to the United States!

Additionally, under the new EB-5 regulations, applicants who meet certain conditions are allowed to simultaneously submit I-526E/I-526 immigration applications and I-485 adjustment of status applications. When submitting the I-485 application, applicants can also apply for travel permits (I-131) and work permits (I-765). Upon receiving the I-485 receipt, applicants may remain legally in the United States; upon approval of the I-765 application, they receive employment authorization and can choose jobs freely; and upon approval of the I-131 application, they obtain advanced parole to enter and exit the United States legally.

Since the implementation of the new EB-5 immigration regulations, rural projects have welcomed their first investor with an I-526E approval, which is also the first I-526E approval case under the new EB-5 regulations, with the approved investor taking only 11 months! It is worth mentioning that since the reestablishment of the EB-5 regional center program, many investors have submitted I-526E applications in the reserved visa pathway, but currently, only rural projects have received approvals. This indirectly confirms the preferential approval rights enjoyed by rural projects have been promptly acted upon by USCIS, evident in the results!

Immigration has two critical elements – timing and choice! Currently, the popular "Florida Lakeside Jewish Community" project complies with the rural TEA project requirements under the new regulations, enjoying EB-5 visa reserved quotas and prioritized processing by USCIS, combining advantages such as no priority date, project job multiplier reaching 5.44, and EB-5 funds enjoying first-priority collateral security! Great projects wait for no one; potential investors should act swiftly!
