Great news! Recently, a large number of Worldway Group's EB-5 immigration clients who utilized 'concurrent filing' have received the exciting news that their I-765 Employment Authorization Documents (EAD) and I-131 Advance Parole travel permits have been approved. They are now free to work and travel in and out of the United States. Worldway Group extends its heartfelt congratulations to these investors.
It is worth noting that when these investors applied for U.S. immigration through Worldway Group's visa-backlog-free EB-5 project, they simultaneously filed their I-526E immigrant petitions and I-485 applications to adjust status. Furthermore, these clients also applied for I-131 travel permits and I-765 employment authorization. Previously, these clients had already received their I-765 approval notices and work cards. Recently, they have also received the good news that their I-131 travel permits have been approved and their travel documents issued, allowing them to travel freely in and out of the United States with their passports. In other words, these investors can now work and travel freely in the U.S.; the applicants and their spouses can work legally, their children can attend local public schools, and they can apply for local state government health insurance, enjoying most of the conveniences of life as U.S. residents.
As you may know, the EB-5 Reform and Integrity Act of 2022, enacted by the U.S. Congress last year, provides significant benefits to investors and their families. This includes the ability to submit two important applications simultaneously, allowing eligible applicants to file their I-526E/I-526 immigrant petitions and I-485 applications to adjust status at the same time, a process known as 'concurrent filing.' Additionally, applicants can also apply for I-131 travel permits and I-765 employment authorization. So, what conditions must be met to qualify for 'concurrent filing'?
◆ The EB-5 category has no visa backlog or the priority date is current
◆ The applicant must have entered the United States on a non-immigrant visa
◆ Meet the requirements for the duration of stay in the U.S.
◆ Have maintained a legal status consistent with their non-immigrant visa
◆ No criminal record
◆ Pass a medical examination
In other words, for investors, if the immigration category applied for has no backlog and the applicant is currently within the United States and meets the corresponding conditions, they can file their I-485 adjustment of status application, as well as their I-131 travel permit and I-765 employment authorization applications, at the same time as their immigrant petition, thereby allowing them to live and work in the U.S. sooner.
