Recently, the U.S. Citizenship and Immigration Services (USCIS) issued an official notice on its website: effective March 15, 2023, the fingerprint requirement and the $85 fee for EB-5 Regional Center applicants (Form I-526E) have been eliminated. This means that EB-5 Regional Center investment immigration applicants are no longer required to submit a biometric services fee with Form I-526E.
Since the release of Form I-526E in 2022, USCIS has received approximately 980 I-526E applications that included the biometric fee. USCIS will refund these fees in the coming weeks. Applicants do not need to contact USCIS to request a refund.
Meanwhile, USCIS released a revised version of Form I-526E and updated instructions on March 15, 2023 (local time). Starting May 15, 2023, USCIS will only accept the revised version of Form I-526E. During the two-month transition period, applicants may submit either the new or the old version of Form I-526E (dated June 1, 2022). The edition date can be found at the bottom of the form page, along with the instructions. Applicants should note that the old version of Form I-526E still contains instructions regarding fingerprinting requirements, which are no longer accurate.
On July 12, 2022, as part of the EB-5 Reform and Integrity Act of 2022, USCIS first published Form I-526E, Immigrant Petition by Regional Center Investor. Under Section 203(b)(5) of the Immigration and Nationality Act (INA), investors apply for U.S. immigration status with USCIS using Form I-526E by participating in a pooled investment program through a Regional Center.
The U.S. EB-5 investment immigration program has long been an effective and relatively fast way to obtain a U.S. Green Card. The application requirements are flexible, with no restrictions on age, education, language, business background, or work experience. With an investment starting at $800,000, the entire family can immigrate to the United States, live and work anywhere in the country, children can enjoy free public education (K-12), and spouses and unmarried children under 21 can immigrate together.
