At the same time, the new act allows applicants who meet certain conditions to concurrently file an I-526E/I-526 immigration petition and an I-485 application to adjust status. Upon receiving the I-485 receipt, applicants can legally reside in the United States for an extended period. With the approval of the I-765 (typically 3-6 months), they can obtain an Employment Authorization Document (EAD) to legally and freely choose employment; with the approval of the I-131 (6-12 months), they obtain Advance Parole (AP) to legally enter and exit the United States freely. In other words, after these applications are approved, applicants can work and travel freely within the United States. Applicants and their spouses can work legally, children can attend local public schools, and they can also apply for local state government health insurance, enjoying most of the conveniences of life available to U.S. residents.
There are two key elements to immigration: timing and selection! When immigrating to the U.S. via the EB-5 investment path, choosing the right project is crucial.
