The agency stated that as long as the I-90 application is submitted before the green card expires, regardless of whether the current green card is about to expire or has already expired, the extension will be for 24 months based on the original expiration date.
Previously, after receiving the USCIS acceptance notice (Form I-797), this I-797 along with the expired green card could be presented as valid identification for the applicant, with a validity period of 12 months. After the implementation of the new policy, the validity period of the I-797 received thereafter is 24 months. USCIS has also begun to issue I-797 forms with a validity period of 24 months to applicants who have previously submitted I-90 applications and have not yet received their new green cards.
Form I-90 (Application to Replace Permanent Resident Card) is specifically used for situations regarding the renewal of green cards or for replacing lost green cards.
Common situations that green card holders need to replace their green cards include:
The green card has expired or will expire within the next six months;
The original green card is lost, stolen, damaged, or defaced;
There is incorrect information on the received green card that needs to be corrected;
There has been a legal change in personal information, such as a name change, after receiving the last green card;
The green card was lost in the mail and has not been received.
It is important to note that holders of conditional green cards (conditional permanent residents) cannot directly apply for renewal via Form I-90; they must first apply to USCIS to remove the temporary conditions. Only after approval and obtaining a permanent green card can they use Form I-90 in the situations mentioned above.
