In today's era of information and big data, the protection of personal information has become a widely discussed topic of concern, and an increasing number of enterprises across countries and regions worldwide are beginning to attach great importance to it. Regarding personal data protection, the major European nation of Turkey has enacted relevant legislation aimed at fully protecting the privacy of its citizens, serving as a model.

Recently, Dr. Selim Sarıibrahimoğlu, founder of the Selim Sarıibrahimoğlu Law Office in Turkey, who also serves as the Honorary Consul General of Iceland in Ankara and was awarded the Order of the Falcon by the President of Iceland, H.E. Guðni Th. Jóhannesson, specifically wrote to Dr. Winner Xing, Chairman of WorldWay Group. In his letter, he mentioned that "the protection of personal information is increasingly becoming a topic that brings significant impact to individuals and businesses!"

At the end of the letter, Dr. Selim Sarıibrahimoğlu provided Dr. Winner Xing, Chairman of WorldWay Group, with detailed information regarding the "Turkish Personal Data Protection Law."

A Quick Overview | Turkey's Personal Data Protection Law

The following is a partial summary of the "Turkish Personal Data Protection Law"

Since the "Personal Data Protection Law" No. 6698 came into effect in 2016, all companies processing personal data have had the obligation to comply with a series of procedures regarding personal data protection. Failure to comply with these procedures or the occurrence of information security breaches will result in severe penalties. Although many companies believe they are not processing personal data, they are in fact processing large amounts of it. The individuals involved in this data include: employees in personnel files, company officials in various contracts signed between companies, other company employees in invoices, shipping documents or delivery notes, web users involved in cookies on company websites, or web browsers captured in camera recordings. Therefore, regardless of the company's field of activity or size, and regardless of the density, category, or quantity of personal data processed, all companies have the obligation to comply with the necessary procedures to protect personal data, as well as to anticipate potential risks and take necessary administrative and technical measures to prevent any information leakage.

The Personal Data Protection Authority is a public legal entity with administrative and financial autonomy, established in Ankara in 2017 under the Ministry of Justice, in accordance with the duties assigned to it by the "Personal Data Protection Law" No. 6698. The authority's management consists of the President and the Board of Directors, which is its decision-making body. According to the 2021 Annual Report of the Personal Data Protection Authority, since its establishment, the total amount of fines issued by the authority has reached approximately 70 million Lira. This figure is a sign of the authority's efforts to encourage companies to comply with regulations in the field of personal data protection as soon as possible.

The effective date of the "Personal Data Protection Law" No. 6698 is April 7, 2016. The scope of the law is explained in Article 2 as follows: "The provisions of this Law shall apply to natural persons whose personal data are processed, and to natural or legal persons who process such data wholly or partly by automated means or by non-automated means which form part of a filing system."

Basic terminology in the "Personal Data Protection Law" indicates that "processing of personal data" refers to any operation performed on personal data, whether or not by automated means, such as collection, recording, storage, preservation, alteration, adaptation, disclosure, transfer, retrieval, making available, classification, or preventing the use thereof. "Special categories of personal data" refers to personal data relating to race, ethnic origin, political opinions, philosophical beliefs, religion, sect or other beliefs, appearance, membership of associations, foundations or trade unions, data concerning health, sexual life, criminal convictions and security measures, as well as biometric and genetic data, all of which are considered special categories of personal data.

Regarding the "Personal Data Protection Law," an important point that is easily overlooked is that each specific case must be evaluated based on its own merits. Because every company is different, the laws, regulations, and contracts relied upon, as well as the compliance processes to be implemented, must be tailored to the company. Generally speaking, processing personal data with the explicit consent of the data subject is in compliance with the law. However, on the other hand, making the granting of consent a condition for the company's services may also be considered a violation of the law, as it is not given freely. Therefore, it is necessary to independently analyze each personal data processing situation, check the regulations and contracts that the company must comply with, and ensure that the compliance processes to be implemented are specifically applicable to that company.

In the era of big data, personal information leakage has seriously disturbed the peace of people's daily lives. The comprehensive implementation of Turkey's Personal Data Protection Law directly addresses the issues of personal data collection and usage that people are concerned about, which is great news for immigrant investors!

Turkey spans the two continents of Asia and Europe, implements the European model in politics, culture, economy, and other fields, and possesses a solid industrial foundation. It is one of the world's emerging economies and one of the fastest-growing countries globally. Its unique geographical location, vibrant workforce, and stable political and economic environment make Turkey an important strategic investment position and a preferred destination for investors to plan their identity.

Currently, the Turkish deposit-based immigration program is also highly favored. Investors who deposit 500,000 USD or an equivalent amount in foreign currency can apply for a passport from the major European nation of Turkey for their whole family. The procedures for Turkish deposit-based immigration are simple and convenient, with fast approval times. There are no requirements for language, education, or residency, no proof of source of funds, and no need to provide a certificate of no criminal record. The entire process can be handled domestically, and multiple banks in Turkey can facilitate remote account opening without the need to visit! For investors, moving their deposits to a new location to gain both wealth and identity is a move that achieves multiple goals at once. After 3 years, the deposit can be withdrawn at any time, and a certain return can also be obtained. More importantly, investors have flexible funds and fewer requirements, as long as they can meet the deposit requirements.

At the same time, holders of a Turkish passport can have their children receive high-quality education in Turkey, or receive international education without leaving the country, aligning with European and American education systems, with a high probability of entering world-renowned universities. Furthermore, if children choose to return to their home country for development, they can easily enroll in domestic prestigious universities, such as Tsinghua University or Peking University, as international students without taking written exams. A Turkish identity gives children more choices for their future and easily achieves "dual-track" education planning!
