The Immigration Department stated that since the establishment of the Hong Kong Special Administrative Region on July 1, 1997, in accordance with the Immigration Ordinance, non-Chinese Hong Kong permanent residents who are no longer ordinarily resident in Hong Kong will lose their permanent resident status if they are absent from Hong Kong for a continuous period of 36 months or more.
When the department determines whether a relevant person is no longer ordinarily resident or is only temporarily absent, it will consider the circumstances of each case in accordance with the Immigration Ordinance, including the reason, duration, and frequency of the person's absence from Hong Kong, whether they have a habitual residence in Hong Kong, whether they are employed by a company based in Hong Kong, and the location of their principal family members.
As for Chinese Hong Kong permanent residents, they remain Chinese citizens unless they apply to the Immigration Department and are approved to renounce their Chinese nationality or declare a change of nationality. Regardless of whether they are absent from Hong Kong for a long period, they will not lose their Hong Kong permanent resident status.
