The U.S. Department of State's Visa Office has officially released the Visa Bulletin for May 2020, the eighth month of the 2020 fiscal year. Although delayed, the EB-5 immigrant visa has brought another surprise. For Table A, the final action date is July 1, 2015, which is an advancement of 47 days following the significant 5.5-month jump in March. For Table B, the date remains December 15, 2015, unchanged after the significant 7-month advancement in March.
Table A: Final Action Date (FAD)
(Note: For consular processing at the Guangzhou Consulate & filing Form I-485 for adjustment of status with USCIS)

Table B: Date for Filing Application (DFF)
(Note: For those already holding legal residence in the U.S. and filing Form I-485 for adjustment of status with USCIS)

【Worldway Group Interpretation】
I. The EB-5 investment immigration visa cutoff date is July 1, 2015. Investors who have received I-526 approval and have a priority date earlier than July 1, 2015, may enter the final stage of consular interviews or file an I-485 adjustment of status application in the United States to apply for an immigrant visa or change their immigration status. Although the U.S. Consulate has suspended interviews due to the pandemic, the National Visa Center (NVC) has not interrupted the issuance of fee payment notices to eligible investors. Receiving an NVC fee notice means the applicant has entered the interview process, the risk of children aging out is mitigated, and the family can prepare the necessary documents for the DS-260 application. Once the DS-260 is approved and the pandemic eases, allowing the consulate to reopen, they can officially schedule an interview.
II. It is worth noting that USCIS did not open Table B in April. Whether Table B will be opened in May remains to be seen. When Table B was opened in March, Worldway Group successfully completed the I-485 filings for all applicants who met the criteria at that time.
So, why did the May visa schedule advance significantly again after the major acceleration in March?
Although the acceleration of the visa schedule is influenced by some external objective factors, visa scheduling has its own internal consideration mechanisms. Observing and analyzing the dynamics of these internal factors is undoubtedly helpful for correctly understanding schedule changes and predicting future trends.
Generally, when predicting the EB-5 visa schedule for a specific country or region, three factors are mainly considered: 1. Changes in the number of people who have received I-526 approval and are waiting at the NVC to enter the immigrant visa application process; 2. The number of applicants waiting for USCIS I-526 approval (after deducting the rejection rate); 3. The number of people from other countries who are "legally cutting in line" due to the "per-country visa quota limit."
Since the U.S. Citizenship and Immigration Services (USCIS) administrative reform regulations took effect on November 21, 2019, the EB-5 investment amount has increased significantly to $1.8 million ($900,000 for TEA projects). The increase in investment amount has caused the demand for EB-5 visas in emerging markets to drop significantly, even approaching a freezing point. This will have a positive impact on the EB-5 visa schedule for investors from mainland China—the phenomenon of legal "line-cutting" will be significantly eliminated (this is consistent with the prediction on the visa schedule in the "Six Major Immigration Trends of 2020" released by Worldway Group at the beginning of the year). In this context, the advancement of EB-5 visas for mainland China is logical. We will continue to observe and interpret future changes in visa schedules.
As you know, in March, Table A advanced by 5.5 months and Table B by 7 months, allowing a large number of investors to land in the U.S. about 2 years earlier than previously predicted; many investors who were facing the risk of their children aging out have thus gained a major turning point. In May, the EB-5 visa schedule Table A advanced by another 47 days, which will surely provide a significant turning point for more families' U.S. immigration plans.
EB-5 visa holders have been granted an exemption in the recent "Proclamation Suspending Entry of Immigrants Who Present a Risk to the U.S. Labor Market During the Economic Recovery Following the COVID-19 Outbreak" signed by President Trump. Affected by the pandemic, the world (including the United States) will enter a long period of economic recovery. The EB-5 investment immigration program aims to drive overseas investment and create jobs for the United States, and we believe its status in the overall U.S. immigration framework will be highlighted in the future. We have reason to look forward to more good news.
