The U.S. Department of State's Visa Office has officially released the visa bulletin for April 2020, the seventh month of the 2020 fiscal year, for the EB-5 Investment Immigration Program. The latest results show that for Chart A, the cut-off date for EB-5 applicants remains unchanged from March at May 15, 2015; Chart B also remains unchanged, holding at December 15, 2015. With USCIS announcing that Chart B will not be used in April, the filing of U.S. investment immigration I-485 adjustment of status applications has entered emergency mode.
Chart A: Final Action Date (FAD)
(Note: For Guangzhou Consulate visa interviews & USCIS I-485 adjustment of status filings)
Chart B: Date for Filing Application (DFF)
(Note: For those already holding a legal residence status in the U.S. to file Form I-485 with USCIS)
【WorldWay Analysis】
I. The cut-off date for EB-5 investment immigration visas is May 15, 2015. Investors who have received I-526 approval and have a priority date earlier than May 15, 2015, may proceed to the final consular interview or file an I-485 adjustment of status application within the United States to obtain a green card.
II. It is worth noting that USCIS has announced that Chart B will not be enabled for April. This marks the first time in the 2020 fiscal year that Chart B has not been enabled after six consecutive months. WorldWay will continue to monitor whether USCIS will enable Chart B next month.
As everyone is aware, Chart A advanced significantly by 5.5 months and Chart B improved by 7 months in March, allowing a large number of investors to enter the U.S. approximately two years ahead of previous projections. As the WorldWay Group, a top 500 Asian brand with over 20 years of focus on investment immigration, we launched an emergency fast-track filing service immediately after the priority date acceleration last month. Although Chart B is not being used in April, WorldWay’s internal documentation teams and customer service NVC visa groups, in collaboration with the group’s North American client relations department and relevant law firms, will continue to race against time, working to file I-485 adjustment of status applications for applicants who met the eligibility criteria for March.
