[Worldway Group Interpretation]
I. The EB-5 investor visa cut-off date is December 1, 2014, an advance of 9 days. Investors who have received I-526 approval and have a priority date earlier than December 1, 2014, may proceed to the final consular interview stage or file an I-485 Adjustment of Status application in the U.S. to obtain a Green Card.
II. USCIS enabled the use of Table B during the first four months of the 2020 fiscal year, i.e., October, November, and December 2019, and January 2020. Whether Table B will be enabled in the future remains to be seen.
The U.S. immigration administrative reform regulations officially took effect on November 21, 2019: the investment amount for projects in Targeted Employment Areas (TEA) increased from $500,000 to $900,000; the investment amount for projects outside TEA areas increased from $1 million to $1.8 million. Furthermore, most existing high-unemployment TEA projects no longer meet the TEA certification requirements, and the investment amount for continuing to invest in such EB-5 projects has risen from $500,000 to $1.8 million, an increase of 3.6 times compared to before the regulations took effect.
With the substantial increase in U.S. immigration investment amounts, demand from emerging EB-5 markets such as India and Vietnam is expected to decrease, which will have a positive impact on Chinese investors—the phenomenon of "queue jumping" will be significantly eliminated, and the wait time for visas will be drastically shortened. Additionally, as the EB-5 visa quota for the 2020 fiscal year has increased, the backlog issue that has plagued investors born in mainland China may be effectively alleviated. For investors with a genuine need to immigrate to the United States, current EB-5 projects that comply with the new TEA region regulations—projects requiring an investment of $900,000—are a superior choice.
