As of December 15, 2019, the second phase of Canada's new Air Passenger Protection Regulations will come into effect to protect travelers to and from Canada and within Canada.
According to the latest regulations, the compensation rules for major airlines (such as Air Canada, WestJet, and Air Transat) are as follows: a delay of 3-6 hours will result in compensation of CAD 400; a delay of 6-9 hours will result in compensation of CAD 700; and a delay of over 9 hours will result in compensation of CAD 1,000. For smaller airlines (such as Swoop), the compensation amounts are CAD 125, CAD 250, and CAD 500, respectively. Under the new regulations, airlines will also take measures to ensure that children under 14 sit next to accompanying adults at no extra charge.
These regulations apply to flights within Canada, international flights to and from Canada, and flights connecting through Canada.
Airlines are required to compensate passengers only if the cause of the flight delay or cancellation is within the airline's control.
The first phase of the Air Passenger Protection Regulations came into effect on July 15, 2019, which includes requirements for airlines to ensure that adequate food and drink, ventilation, and heating are available on board if a flight is delayed on the tarmac after passengers have boarded; all restrooms must also be operational. If the delay lasts more than three hours, passengers must be allowed to leave the aircraft unless it is about to take off.
Airlines must update passengers on flight delays or cancellations every 30 minutes, including notifications via voice, email, and text messages. According to the new regulations, if an airline causes passengers to miss their flight due to controllable circumstances such as overbooking, they must provide affected passengers with compensation of up to CAD 2,400; if luggage is damaged or lost, they must provide compensation of up to CAD 2,100.
After the new regulations come into effect, airlines will be required to comply with these rules, or they will face fines of up to CAD 25,000 per incident.
