In the latest news, the official website of the immigration bureau has announced that the B Chart will be activated again in December (the third month of the 2020 fiscal year). Additionally, the State Department previously announced the visa quotas for various categories for the new fiscal year 2020, among which the EB-5 visa quota has increased by 1111 visas.
B Chart Activation, Please Expedite Your Status Adjustment
In December, applicants who have obtained other legal residency status in the United States can refer to the B Chart published by the State Department's Visa Office, also known as the "Date Of Filing Chart," to submit their status adjustment application (I-485 application) to the immigration bureau.
B Chart: Date for Filing Application (DFF)
(Note: Applicants who have obtained legal residency status in the U.S. can submit I-485 status adjustment applications to the immigration bureau)
This is the continuation of the activation of the B Chart by the immigration bureau following the first and second months of the new fiscal year 2020, specifically October and November 2019.
According to the announcement from the State Department's Visa Office: For the A Chart, the cutoff date for EB-5 applicants is November 15, 2014; for the B Chart, the cutoff date for EB-5 applicants is May 15, 2015. The difference in cutoff dates between the A and B Charts is approximately 180 days. This is undoubtedly a significant benefit for applicants who have obtained other legal residency status in the United States and are looking to adjust their status.
Eligible applicants should seize this valuable opportunity to submit their I-485 status adjustment applications. WorldWay Group will keep an eye on whether the immigration bureau will continue to activate the B Chart next month.
An Additional 1111 EB-5 Visas for the New Fiscal Year 2020
Furthermore, the official website of the U.S. Department of State has officially announced the visa quotas for various categories for the new fiscal year 2020, among which the EB category (employment-based visa application category) can issue a total of 156,500 visas, representing a 12% increase compared to the previous approximately 140,000 visas. Notably, 1111 visas have been allocated from other categories to EB-5, meaning that the total number of EB-5 visas for the fiscal year 2020 is 11,111.
This aligns with the previous predictions made by Charles Oppenheim, the Director of the Visa Office at the U.S. Department of State. At the same time, Charles Oppenheim also predicted that the usage of EB-5 visas from other countries and regions in the world for the fiscal year 2020 will be less than that of the fiscal year 2019. After deducting the usage from other countries and regions, approximately 5200 available visas will mostly be reserved for applicants from mainland China who are waiting for their priority dates. This represents a 20% increase compared to the approximately 4000 visas issued to applicants from mainland China in the fiscal year 2019.
As we know, with the implementation of the administrative reform regulations by the U.S. immigration bureau, it marks the beginning of a new era for EB-5 investment immigration.
Moreover, with the significant increase in investment amounts for U.S. immigration, the application demand from emerging EB-5 markets such as India and Vietnam will decrease, which will have a positive impact on Chinese investors—legitimate "queue-jumping" phenomena will be significantly reduced, and the waiting time for visas will be greatly shortened. Additionally, with the increase in EB-5 visa quotas for the fiscal year 2020, the priority date issues that have troubled investors from mainland China may be effectively alleviated.
For investors with a strong demand for immigration to the United States, hesitation will result in losses not only in terms of money but also in irreplaceable opportunities. Some say that the era of low-cost EB-5 investment immigration has ended, but the facts also tell us that everything in the new era is developing in a positive direction. No matter when, "apply early, queue early" remains the guiding strategy for investment immigration!
