The U.S. Department of State’s Visa Office has officially released the Visa Bulletin for October 2019, the first month of the new 2020 fiscal year, for the EB-5 Immigrant Investor Program. The latest results show that for Chart A, the final action date for EB-5 applicants is October 22, 2014; for Chart B, the date has advanced significantly by 5 weeks compared to September, reaching January 1, 2015.
It is encouraging that USCIS continues to release positive news. U.S. Citizenship and Immigration Services (USCIS) has officially announced that for October 2019, the first month of the new 2020 fiscal year, applicants who have already obtained other legal residence status in the United States may refer to the "Date of Filing Chart" (Chart B) published by the Department of State’s Visa Office to submit their adjustment of status applications (Form I-485) to USCIS.
USCIS enabled Chart B for the first four months of the 2019 fiscal year (October 2018 to January 2019), but suspended its use starting from the fifth month, February 2019. After an 8-month suspension, Chart B has finally been re-enabled for October 2019, the first month of the 2020 fiscal year.
According to the Department of State’s Visa Bulletin: for Chart A, the final action date for EB-5 applicants is October 22, 2014; for Chart B, the filing date for EB-5 applicants is January 1, 2015. The difference between the dates in Chart A and Chart B is approximately 70 days. This is undoubtedly a major benefit for applicants who have already obtained other legal residence status and are within the United States seeking to adjust their status.
