Worldway Group has learned that in February 2019, Immigration, Refugees and Citizenship Canada (IRCC) released new regulations. The Canada Border Services Agency (CBSA) will track individuals departing Canada by land and air, with implementation scheduled for June of this year and June of next year, respectively.
In other words, starting in June, the Canada Border Services Agency will implement new entry and exit record regulations! This also means that Canada will have a much clearer understanding of the travel movements of departing individuals.
In the past, after entering Canada, there were no exit checkpoints or records upon departure, and individuals could board flights even after their authorized stay had expired. So, how will the new exit regulations work?
When departing, individuals do not need to report to customs. However, the Canada Border Services Agency will collect information on departing individuals from the U.S. Customs and Border Protection (CBP) (individuals reporting entry at U.S. land customs are considered by Canada to be departing) or from other institutions such as commercial airlines.
Under the new Entry/Exit Information Regulations (EIR), airlines must begin providing passenger information to the Canada Border Services Agency 72 hours before flight departure. As a result, Immigration, Refugees and Citizenship Canada (IRCC) and the Canada Border Services Agency will soon be able to obtain accurate and objective entry and exit information. The immigration department has announced that all collected information will be used directly for the following six purposes:
1. To verify the length of time an individual has resided in Canada and whether it matches the residency duration provided in their citizenship or Permanent Resident card renewal application;
2. To confirm whether a temporary resident applicant has previously overstayed in Canada;
3. To confirm whether a sponsor is residing in Canada as required by law;
4. To confirm, in family reunification applications, whether the relationship between the applicant and the sponsored person constitutes a valid spouse or partner relationship;
5. To confirm whether a refugee has entered the country based on the refugee applicant's travel documents;
6. To confirm an individual's length of residence to determine if a medical examination is necessary.
Under this policy, the Canada Border Services Agency will include the entry and exit information of all travelers. In addition to ensuring that all departing visitors leave as required, determining the length of stay in Canada based on entry dates, and confirming timely departure, it will also better combat criminal activities by terrorist organization members, respond more effectively to missing children cases, and better combat human trafficking.
Furthermore, it will help track the whereabouts of illegal immigrants and help prevent fraud, such as individuals falsely reporting their days spent in Canada to claim Canadian social welfare benefits or abusing the Canadian public healthcare system.
As is well known, Canada has always been highly sought after by new immigrants due to its beautiful environment, generous social welfare, and relaxed immigration policies. For those who wish to reside in Canada long-term, they must go through formal channels to obtain an immigration visa and become a legal resident.
