As is well known, on February 7 of this year, Quebec Immigration Minister Simon Jolin-Barrette proposed a new Quebec bill at a press conference—Bill 9—which plans to "discard" the current backlog of 18,000 Quebec skilled worker immigration applications. Once announced, this bill immediately caused an uproar worldwide. Although the Quebec Association of Immigration Lawyers (AQAADI) followed up by filing a lawsuit against the immigration department, and the Quebec Superior Court ruled that: "The immigration department may not terminate the processing of these 18,000 skilled worker applications until the National Assembly of Quebec successfully passes this bill into law." However, unexpectedly, this matter has not subsided, and the policy of "one-size-fits-all" for Quebec skilled worker applications now appears to be a foregone conclusion.
Worldway Group has learned: On April 9, 2019, Canadian time, the highly controversial new immigration system reform bill of the Quebec CAQ government—Bill 9—took a new step: the Quebec National Assembly passed the principle of the highly controversial legislative text with 76 votes in favor, 38 against, and 0 abstentions.
The bill proposes the following points regarding the reform of Quebec's immigration law:
First, the new bill will void all 18,000 unprocessed skilled worker applications submitted before August 2, 2018, in order to start a new skilled worker selection process from scratch.
Second, this bill also proposes to amend the existing Quebec immigration law to facilitate the integration of immigrants into the local society. Priority will be given to applicants who possess French language skills, democratic values, and Quebec values that reflect the spirit of the Charter of Human Rights and Freedoms, which was also a promise made by the CAQ to the people of Quebec during the 2018 election.
Third, the new bill will also grant the Minister of Immigration the power to "add additional clauses to the permanent residence status of new immigrants" to ensure that regions and businesses outside major cities obtain the talent they need and meet regional labor demands.
As everyone knows, in the Canadian legal system, local legislatures, especially provincial legislatures, are the highest legislative bodies for local laws, and it is difficult to overturn them unless they are deemed unconstitutional by the federal government. This means that Bill 9 now has legal effect and is no longer just an initiative proposal from the CAQ government two months ago. In other words, these 18,000 skilled worker applicants will find it difficult to escape the fate of being "one-size-fits-all" terminated.
In the current situation where Quebec's skilled worker immigration is undergoing major changes and policy directions are extremely unclear, choosing a secure immigration program is the key to successfully immigrating to Canada. Regarding the Quebec Immigrant Investor Program, the Quebec Ministry of Immigration has relaxed the time for accepting cases, extending it from the original March 15, 2019, to August 31, 2019. The extension of the submission time makes the quota for the next year increasingly "unpredictable." For investors, there are very few quotas and time left now. The only wise move is to seize the opportunity, confirm the quota as soon as possible, and submit the application.
