Worldway Group has learned that the Quebec provincial government has recently decided to abandon its legal challenge and continue processing the 18,139 skilled worker immigration applications previously declared void, pending the passage of new immigration legislation in the provincial legislature. After Quebec Immigration Minister Simon Jolin-Barrette submitted the immigration reform bill on February 7, the Quebec Immigration Lawyers Association applied for and obtained an injunction from the Superior Court of Quebec to prevent the provincial immigration ministry from stopping the processing of these applications before the bill is passed.

The duration of this injunction is until March 7. Now, the provincial immigration ministry and the Quebec Immigration Lawyers Association have reached an agreement, whereby the provincial government will continue to process skilled worker applications received before August 2 of last year after this date, until Bill 9 is officially passed, regardless of how long this process may take.

The Quebec Immigration Lawyers Association stated that this is good news and expressed gratitude to the provincial immigration ministry for abandoning the legal action it had previously claimed it would take.

However, the provincial government has also indicated that it will not increase human or material resources to handle these applications. This means that the processing of these more than 18,000 applications will continue at a rate of 600 per month.

Among the applicants, 3,700 are already working in Quebec. Premier François Legault said that the applications of these individuals will be given priority.

The outlook for Quebec skilled worker immigration is currently unclear, but regarding the Quebec Immigrant Investor Program, the Quebec Immigration Ministry has extended the deadline for accepting cases from the original March 15, 2019, to August 31, 2019. The extension of the submission period makes the quota for the next year increasingly "unpredictable." For investors, the only wise course of action is to seize the opportunity, confirm the quota as soon as possible, and submit their applications.
