According to the latest policy document released by the UK Home Secretary on the evening of January 28 regarding a "no-deal Brexit": EU immigrants who entered the UK before March 29 of this year (including their non-EU family members) can apply for Settled status or Pre-settled status under the EU Settlement Scheme as originally planned by the UK government.
For those EU immigrants who enter the UK after the official Brexit date (i.e., starting March 30 of this year), the UK government will provide a "transition period" that will last until December 31, 2020.
During the transition period, EU citizens who are only visiting for tourism purposes for no more than three months can still use their existing EU identity cards or passports to pass through customs. Such visits of no more than three months do not require any visa application and incur no fees, similar to the concept of visa-free travel to certain countries that we are familiar with.
If EU citizens intend to stay in the UK for more than three months, for example, to work, they will need to apply for a temporary status during the transition period. This status is called "European Temporary Leave to Remain."
The policy document states that the validity of the European Temporary Leave to Remain is 36 months. With this three-year visa, EU immigrants can reside or work in the UK during the transition period until it ends.
Once the transition period ends and the new immigration system is implemented (i.e., starting January 1, 2021), those holding the European Temporary Leave to Remain who wish to continue residing in the UK must apply for the corresponding new status according to the new policy regulations.
Additionally, for those who have already arrived in the UK before the official Brexit and are eligible for the EU Settlement Scheme, they must also apply for their new status before the end of the transition period (December 31, 2020) to ensure their right to continue residing in the UK in the future.
