Recently, the USCIS announced: Starting from June 11, 2018, applicants submitting Form I-829 (Application for Removal of Conditions on Permanent Resident Status) will receive Form I-797 (Receipt Notice). This "Receipt Notice" can be presented along with Form I-551 and the conditional green card to extend the applicant's expired conditional green card status for 18 months. Previously, the I-829 form "Receipt Notice" issued by USCIS could only extend the applicant's expired conditional green card status for 12 months. This update from USCIS to extend the applicant's legal residency status from 12 months to 18 months is a positive response to the increasingly longer processing times for I-829 applications over the past year.
In addition, for applicants who submitted Form I-829 on June 11, 2018, but have not yet received approval, USCIS will issue a new Form I-797 (Receipt Notice) to facilitate these applicants in applying the 18-month extension after their conditional green card expires.
The USCIS announcement also includes that applicants who submitted Form I-751 (Application for Removal of Conditions on Marriage-Based Permanent Resident Status) can also extend their expired conditional green card status for 18 months using the USCIS Form I-797 (Receipt Notice).
The USCIS particularly reminds conditional green card holders that if they plan to stay outside the United States for one year or more, they should submit Form I-131 before leaving to apply for a re-entry permit, also known as a "Returning Resident Visa."
As we know, in recent years, U.S. immigration has remained very popular. The U.S. EB-5 Immigrant Investor Program has a low threshold and few conditions, making it essentially the only immigration method with no language requirements, no age restrictions, no educational requirements, no business background requirements, and no immigration monitoring, thus highly favored by EB-5 investors. Currently, the U.S. EB-5 Regional Center Program has been extended to September 30, but changes to the EB-5 program could occur at any time, and price increases are inevitable.
Therefore, now is the best time to apply for U.S. EB-5 investment immigration. For investors, in the current situation, choosing projects that have already been approved by USCIS, are likely to shorten waiting times, have completed all job creation, and offer first-priority repayment guarantees is key to reasonably responding to a series of policy changes, including significant increases in EB-5 investment amounts.
