Dear Students and Parents:
The New York City Department of Education (DOE) and the Mayor's Office are committed to protecting the right of every New York City student to attend public school, regardless of their immigration status. The U.S. Supreme Court also recognizes the importance of all students receiving a public education, including those who are undocumented. Your children are our top priority, and we will do everything within our power to protect these rights and ensure that all students receive a high-quality education.
We take pride in our diversity. Immigrant parents, students, principals, teachers, and other staff make our schools and New York City wonderful, strong, and vibrant. Whether you or your family arrived here 100 years ago or 100 days ago, you are a New Yorker, and we stand with you to support you.
To help ensure that all students continue to learn in a safe and nurturing environment, we have provided the following instructions to school staff:
As in the past, DOE staff will not inquire about the immigration status of students or their family members, nor will they maintain such records. If you share sensitive information, such as information regarding immigration status, yourself, or your family, the City's confidentiality policies and Chancellor's Regulations require us to keep this information confidential.
DOE staff will not grant Immigration and Customs Enforcement (ICE) unrestricted access. Like all other law enforcement agencies, ICE will not be granted access to schools without proper legal authority. If ICE visits a school for immigration enforcement purposes, they will be referred directly to the principal, who will take appropriate action.
Unless required by law, DOE staff will not release student information.
Anyone seeking immigration legal services at our schools will be referred to ActionNYC. ActionNYC is a program that provides free, safe immigration legal help from trusted community organizations in your neighborhood and in your language.
All New Yorkers, regardless of immigration status, can continue to use City services. Call 311 or visit nyc.gov/immigrants to see more information released by the Mayor's Office of Immigrant Affairs. In addition, the DOE website has various resources: http://schools.nyc.gov/AboutUs/schools/SupportingAllStudents.htm. This section of the website will be expanded in the coming weeks.
School staff will ensure that all students are in a safe and supportive learning environment. It is the policy of the DOE to keep schools safe and inclusive, free from harassment, bullying, and discrimination based on actual or perceived race, color, religion, age, creed, ethnicity, national origin, alienage, citizenship status, disability, sexual orientation, gender, or weight. If there are any issues or concerns, please report them to school staff immediately, and they will investigate and take prompt action.
Thank you for entrusting us with your children's education. Nothing is more important than putting our 1.1 million students on the path to success.
Sincerely,
Carmen Fariña (Chancellor of the New York City Department of Education)
Nisha Agarwal (Commissioner of the Mayor's Office of Immigrant Affairs)
