The Trump administration may revoke work authorization for H-1B spouses in the U.S. The U.S. Department of Homeland Security stated on Thursday (December 14) that it plans to repeal this regulation, which is expected to affect tens of thousands of people, with China potentially being one of the most impacted groups.
Spouses of H-1B visa holders reside in the U.S. on H-4 visas. In February 2015, the Obama administration issued a rule allowing spouses of H-1B visa holders who are in the process of applying for a green card to work in the United States.
However, according to a report by CNN Money, the Department of Homeland Security stated on Thursday (December 14) that in order to implement President Trump's "Buy American, Hire American" executive order, it plans to repeal the regulation that allows H-4 visa holders to work in the U.S.
In addition to repealing the H-4 work regulation, the Department of Homeland Security's statement also mentioned plans to modify the H-1B visa program, including defining which occupations qualify for H-1B requirements and emphasizing the attraction of the "best and brightest" foreign workers.
The H-1B is a common visa pathway for high-skilled foreigners to seek employment at U.S. companies. It is valid for three years and can be renewed for another three years upon expiration, with approximately 85,000 visas issued annually.
Additionally, the U.S. issues approximately 130,000 H-4 visas annually. According to statistics released by the State Department at the end of January this year, a total of approximately 124,000 H-4 visas were issued in 2015.
The Trump administration's plan to reform the H-1B visa program has caused panic among many Chinese H-1B applicants. If the H-4 work authorization is revoked, it will have an impact on many families.
