Analysis Summary
The good news is that for the first time since 2009, the number of EB-5 application adjudications has exceeded the number of filings. This is necessary to reduce visa backlogs and shorten processing times.
Compared to the previous fiscal year, the number of I-526 receipts in fiscal year 2017 decreased by 14%, while the number of I-526 adjudications increased by 31%; the number of I-829 receipts decreased by 24%, while the number of I-829 adjudications increased by 42%.
Although the number of I-526 receipts in fiscal year 2017 decreased, it remains high; as before, quarterly receipt trends show that filing peaks still occur before the expiration of the Regional Center Program.
In fiscal year 2017, the trend of I-829 receipts showed a quarterly decline, which is concerning. Since the Department of State has issued the maximum quota of EB-5 visas annually starting from fiscal year 2014, the number of people filing I-829 applications to remove conditions on their green cards should logically be relatively stable. However, it seems that an increasing number of individuals who obtained conditional green cards have failed to complete the EB-5 process. Encouragingly, the number of I-829 denials remains consistently low.
