As is well known, for current U.S. EB-5 investors, the most significant impact is not the increase in investment amounts, but the issue of EB-5 visa retrogression. How to resolve the concerns regarding retrogression has become a primary focus for EB-5 investors. Recently, news that investing in EB-5 projects in "Urban Priority Investment Areas" may shorten retrogression has reignited the confidence of many investors in immigrating to the United States. So, why are EB-5 projects located in "Urban Priority Investment Areas" expected to shorten retrogression?
As everyone knows, the reform of the EB-5 investment immigration program is not a dispute between the Republican and Democratic parties, but rather a disagreement between the rural and urban factions. The game has been long-standing, but there must be a day when the dust settles. In order to reach a consensus on reform as soon as possible, authorities within both factions have made various efforts.
The visa set-aside proposal—that is, under the premise that the total annual visa quota remains unchanged, reserving a portion of visas for EB-5 investors in specific areas—is precisely the result of a compromise between the rural and urban factions in Congress, without increasing the total EB-5 visa quota.
This compromise is reflected in "The American Job Creation and Investment Promotion Reform Act of 2017" (draft), introduced by Senate Judiciary Committee Chairman Grassley and Senate Appropriations Committee Chairman Leahy on April 15, 2017. According to the draft act, EB-5 investors in projects located in "Urban Priority Investment Areas" will be entitled to 750 priority visa quotas in fiscal year 2018, and 1,500 priority visa quotas annually in fiscal year 2019 and beyond. This proposal does not involve changes to the total EB-5 visa quota and does not require comprehensive immigration reform, making it easier to be passed by Congress.
Meanwhile, Grassley and Goodlatte (2G) proposed "The Last, Best and Final Offer" in October 2017, also known as the "2G Proposal." According to the proposal, EB-5 investors in projects located in "Urban Underdeveloped Areas" will be entitled to 1,500 priority visa quotas annually.【Note: Compared to the "Urban Priority Investment Areas" proposed in the draft act, "Urban Underdeveloped Areas" is merely a change in name, with the conditions remaining the same】
Through the aforementioned drafts/proposals, we can be certain of at least one point: "Visa set-asides" have become a consensus among all reform factions. Granting priority visa quotas to "Urban Priority Investment Areas" is already an inevitable trend.
In addition, Mr. Ronald Klasko, a five-time chair of the "American EB-5 Committee," a renowned U.S. immigration attorney, and a prominent figure in the U.S. immigration field, also stated during his previous visit to WorldWay and his meeting with WorldWay senior management that the provision for granting set-aside visa quotas to "Urban Priority Investment Areas" is almost certain to appear in the new act. He also believes that under the current circumstances, projects in "Urban Priority Investment Areas" will certainly be favored by investors.
This is undoubtedly a shot in the arm for investors currently troubled by retrogression. EB-5 investors who apply for EB-5 projects that meet the "visa set-aside" conditions are expected to shorten their retrogression, obtain green cards on a priority basis, and begin their American journey.
Currently, such projects are very rare in the market. The Manhattan 9 Luxury Boutique Hotel project, exclusively represented by WorldWay in Greater China, is the first project in Manhattan to meet the definition of an "Urban Priority Investment Area." It is expected to shorten retrogression, and the project's various data points are excellent, greatly assisting investors in obtaining permanent green cards and the repayment of investment funds, thereby fully protecting the interests of investors.
