Interpretation of the Latest U.S. Immigration Visa Bulletin and EB-5 Visa Retrogression Forecast for Fiscal Year 2018

  【Worldway Immigration Group Interpretation】

  1. According to Table A, for applicants born in mainland China, the EB-5 visa retrogression remained stagnant in September 2017, holding at June 15, 2014, just as it was last month.

Following the U.S. Department of State's usual practice, September, being the final month of the U.S. fiscal year, typically sees a brief stagnation in visa availability, which is a normal phenomenon.

It is worth anticipating that after the start of the new 2018 fiscal year in October 2017, new quotas will be released. It can be basically predicted that the EB-5 visa retrogression may advance in October 2017.

Table A also implies that if an applicant's priority date is before June 15, 2014, and their I-526 petition has been approved, the applicant can attend an interview at the Guangzhou Consulate or file an I-485 application in the United States starting from September 2017.

  2. Table B, the Date for Filing (DFF) cutoff, remains at September 1, 2014.

It should be noted that whether Table B is open depends on the notification from the U.S. Citizenship and Immigration Services (USCIS).

Within approximately one week, USCIS will publish the USCIS version of the Visa Bulletin Table B on its official website. At that time, all applicants who have obtained legal residence status in the U.S. must refer to the USCIS version of Table B to determine whether they can submit an I-485 Adjustment of Status application.

  【Special Note】

After September 30, 2017 (U.S. time), the new 2018 fiscal year will begin. With only 50 days left until September 30, what will happen to the U.S. EB-5 Immigrant Investor Program Regional Center bill? Will the EB-5 investment amount really skyrocket? Can the EB-5 visa retrogression really be resolved? What is the forecast for EB-5 visa retrogression in fiscal year 2018?

Regarding the above questions, this weekend, Mr. Nicolai Hinrichsen, a partner at the top U.S. immigration law firm Miller Mayer, will personally visit Worldway's Shanghai and Shenzhen offices to continue the tour and provide analysis for investors.
