The U.S. Citizenship and Immigration Services has updated the average case approval progress for EB-5 as of May 31, 2017. The WorldWay Immigration Group now releases and interprets the latest EB-5 case review progress for May 2017 as follows:
As of May 31, 2017, the EB-5 case review times are as follows:
o I-526 application: The review cutoff date is October 18, 2015, which is 17 days ahead of the April cutoff date of October 1, 2015;
o I-829 application: The review cutoff date is December 3, 2014, which is 11 days ahead of the April cutoff date of November 22, 2014;
o I-924 application: The review cutoff date is October 22, 2015, which is 10 days ahead of the April cutoff date of October 12, 2015;
Based on the May review progress, it can be estimated that:
o The average review time for I-526 approvals is approximately 19 months;
o The average review time for I-829 approvals is approximately 30 months;
o The average review time for I-924 approvals is approximately 19 months;
The WorldWay Immigration Group continues to remind investors: due to the specific circumstances of individual applications, the above review times are average times, and generally speaking, exceeding this progress is also considered normal.
The average review time trend over the past year:
Surprising! The backlog remains severe
Although the latest EB-5 cases are progressing slowly overall, based on the average review times for the past year, the overall trend is still upward, and the backlog remains severe. Therefore, investors interested in immigrating to the United States are advised to act quickly to secure their place in line and avoid missing the peak of the backlog.
Delightful! Major positive developments for EB-5
Positive Development 1: A new proposal to resolve the backlog has been introduced, which, if implemented, would change 10,000 applications to 10,000 families, thereby completely eliminating the backlog.
Positive Development 2: The new proposal also suggests that investors can submit their I-829 within two years, which means that the time for investors to obtain permanent green cards may also be shortened.
Positive Development 3: On June 14, the U.S. Citizenship and Immigration Services updated the EB-5 processing policy memorandum, with the most direct change for EB-5 investors being that EB-5 funds can be returned after holding a temporary green card for two years, rather than after I-829 approval. Therefore, EB-5 investors have the opportunity to recover their EB-5 investment funds approximately two years earlier.
Positive Development 4: The United States is the world's leading destination for investment, attracting the most investments from around the globe. Currently, with tax cuts under Trump, a stable U.S. dollar, and a pessimistic outlook for the Chinese yuan, global asset allocation is urgent. The $500,000 investment for immigration to the United States may soon become a thing of the past after September 30, making now the best time to seize the last opportunity for low-cost investment immigration to the United States.
