Many Canadian immigrants enjoy renovating their homes to their preferred style after purchasing them; however, they often face penalties due to a lack of understanding of Canadian laws, leading to non-compliant actions.
In late May 2017, a Canadian court heard a case involving a Chinese immigrant who was sued after accidentally cutting down three trees in front of their home while renovating their villa. This case serves as a vivid lesson for many new immigrants intending to buy property in Canada on how to manage legal risks.
According to reports from YorkRegion.com, in December 2012, a Chinese resident of Markham, Ontario, surnamed Wu, cut down three trees in front of their home without reporting it to the city council while renovating their property, and was reported by a neighbor for illegal tree removal. It was verified that two of the trees belonged to the municipal government.
According to the Markham municipal bylaws, property owners must apply to the city government before cutting down trees. It is illegal to intentionally remove or damage trees that are 1.37 meters or taller and have a diameter of 20 cm or more without prior application.
The City of Markham currently imposes a fine of $500 to $100,000 per tree for unauthorized tree removal. Mr. Wu, having cut down 3 trees, faced a maximum fine of $300,000 (approximately 1.5 million RMB).
