Many people want to immigrate, but they often feel it is very troublesome and complex, which discourages them from starting the process. However, as the saying goes, without a beginning, there cannot be an outcome. Therefore, today we are here to guide you on how to apply for the U.S. Entrepreneur Immigration L1 Visa.
Understand the project application process:
In general, the entire process of the U.S. L1 visa is quite simple.
1. Establish Related Company & Prepare Documentation
2. Write Business Plan
3. Submit Application
4. Interview
6. Arrival
If everything goes smoothly, the process can be completed within six months.
1. Establish Related Company
If you are aware of the U.S. Entrepreneur Immigration L1A visa, you will know that this multinational executive visa is just like a green card. It requires you to have a company in your home country as well as a related company in the United States.
As an executive from a domestic company sent to the United States, you carry the glorious mission of building the American company!
Clearly, you will need to establish a company in the United States that is related to your domestic company. You can either open a subsidiary under your domestic company's name in the United States, invest in an existing company, or acquire a company; note that these actions must be between companies.
Once the U.S. company is registered, you need to make an investment:
For a new company, we need to open a company account. If it is through acquisition or investment in a company, we can directly wire the initial capital. Generally, you are required to be present to open a U.S. company account.
2. Prepare Documentation
The business plan is a critically important document for the L1A application. During the L1A review process, the immigration bureau emphasizes the development prospects of your U.S. company and your management capabilities, relying on this information to determine whether to approve your application. Thus, a high-quality business plan is pivotal for success when submitting the application.
This document must provide detailed and reasonable descriptions of your domestic company, U.S. company's situation and business outlook, as well as your personal job responsibilities; this will serve as the basis for the U.S. immigration bureau to trust you.
To ensure authenticity, you need to collect relevant documents from both companies and your personal information to substantiate the business plan.
3. Submit Application
If you choose expedited processing, the immigration bureau must respond to you within 15 business days.
There are generally three types of responses: approved / request for additional information / denied
If approved, you can schedule an interview at the embassy and go for the interview at the appointed time. If you need to apply for an L2 visa for your family, prepare their documentation, bring the L2 application form, and attend the interview together.
It is essential to prepare thoroughly before the interview. You need to be well-informed about both your domestic and foreign companies, your case, and related details. The interview is crucial and significant; proper preparation is necessary, as it could jeopardize all your previous efforts.
If the immigration bureau issues a request for additional information during the review process, that means they have questions regarding some of your documents and require you to provide further evidence. At this point, you should analyze the request and determine what supplementary materials would be most convincing, then provide them again. If you previously opted for expedited processing, you will still receive a result within 15 days following the additional information submission.
If the visa is denied, the denial letter will list the reasons for the denial, and generally, you will have one opportunity to appeal to make a last effort. You may also resubmit the application. Generally, resubmitting after a year will yield a higher success rate.
04. Completion
Once the interview is passed, you and your family can wait for the return of your passports and then proceed to the United States.
