Recently, U.S. Citizenship and Immigration Services (USCIS) announced a series of new measures to further strengthen the detection and deterrence of fraud and abuse in the H-1B visa program. This follows the previously announced suspension of Premium Processing Service for all H-1B petitions effective April 3.
USCIS stated that employers who abuse the H-1B visa program by bringing in foreign workers negatively impact U.S. workers and hinder local employment opportunities. To address this, USCIS will not only conduct targeted site visits but will also continue to perform random and unannounced investigations across the country.
USCIS will focus its investigations on the following key areas:
• Cases where USCIS is unable to verify basic business information through commercial data;
• Employers that are H-1B dependent, meaning they employ a higher number of H-1B workers than U.S. workers;
• Employers filing H-1B petitions for foreign workers who will be working at other companies or organizations.
Since taking office, President Trump has strictly enforced the two core principles of "Hire American, Buy American." The latest aggressive move by USCIS targeting fraud and abuse in the H-1B non-immigrant work visa program is a direct reflection of Trump's mandate to "Hire American" and "Create Jobs for Americans."
Under the new Trump administration, while various immigration visa policies are tightening significantly, they are also undergoing fundamental changes. The legal U.S. investment immigration program, the EB-5 visa, has become one of the most reliable pathways to obtaining a U.S. Green Card and remains one of the few immigration categories not criticized by President Trump to date.
As is well known, the EB-5 investment immigration program not only boosts the U.S. economy but also creates a large number of jobs for Americans, which aligns perfectly with President Trump's two core principles.
