U.S. Citizenship and Immigration Services (USCIS) recently announced that it will suspend premium processing service for all H-1B petitions starting April 3, 2017. This suspension may last for up to six months.
This means that H-1B petitions for the 2018 fiscal year, which can be filed starting April 3, 2017, will not be eligible for premium processing. If a petition is submitted with Form I-907, Request for Premium Processing Service, the petition will be rejected. Premium processing will also be suspended for petitions that are exempt from the cap.
However, USCIS also announced that petitioners may request expedited processing if the delay in processing meets one or more of the following criteria:
• Severe financial loss to a company or person;
• Emergency situation;
• Humanitarian reasons;
• Nonprofit organization request in furtherance of the cultural and social interests of the United States;
• Department of Defense or national interest situation (these particular expedite requests must come from an official U.S. government entity and state that the delay will be detrimental to the government);
• USCIS error;
• Compelling interest of USCIS.
USCIS officers will use their discretion to handle expedite requests on a case-by-case basis.
With the successive introduction of new policies under the Trump administration, the investment environment and policies for U.S. immigration are gradually tightening, and various immigration policies are undergoing fundamental changes. As birth tourism, F-1, H-1B, L-1 visas, as well as EB-1C and EB-3 visas are being strictly scrutinized or cracked down upon, the U.S. investment immigration visa, known as the EB-5, has become one of the most reliable ways to obtain a U.S. Green Card today, and it is also the only immigration category that has not been disparaged by Trump so far. As is well known, the EB-5 visa is an immigration category that creates jobs for the United States, rather than taking away American jobs.
As the EB-5 program undergoes reform and is about to see a significant price increase to $1.8 million, three high-quality projects already approved by Worldway Group are sparking a buying frenzy in the market. Among these three projects, there are high-quality projects where all job creation has been completed ahead of schedule and exceeded targets, clearing the most important obstacle for investors applying for permanent Green Cards.
