United States Permanent Resident Card, also known as a Green Card, is issued to individuals who intend to make the United States their long-term place of residence. At any time, if a Green Card holder abandons the intention of making the United States their long-term residence, they lose the right to hold a Green Card. Therefore, it is crucial for all immigrant friends to understand how to maintain their U.S. Green Card status.
U.S. immigration law stipulates that if a Green Card holder stays outside the United States for more than 180 consecutive days, even if they have not voluntarily abandoned their Green Card, U.S. Citizenship and Immigration Services (USCIS) has the right to question whether they still intend to make the United States their long-term place of residence when they apply for re-entry using their Green Card. However, this does not mean that a Green Card holder will not lose their permanent resident status if they return to the United States for a few days every 6 months. If you maintain a pattern of returning to the United States once every 6 months, there may be no consequences within the first 2 to 3 years, but over time, this increases the risk of being deemed by immigration authorities to have abandoned the intention of permanent residence in the United States.
The proper approach is for the Green Card holder to inform USCIS in advance if they may be away from the United States for more than six months by applying for a Re-entry Permit, demonstrating that they have no intention of abandoning their permanent resident status. If you cannot avoid living outside the United States for an extended period, keep the following evidence to respond to any challenges from immigration authorities regarding your intent for permanent residence:
1、File income tax returns on time every year in accordance with the regulations of the Internal Revenue Service (IRS) and keep records of your tax filings.
2、Maintain a residential address in the United States.
3、Maintain a bank account in the United States.
4、Possess a valid U.S. driver's license and carry it with you when entering the country.
5、Possess U.S. credit cards.
6、Own property in the United States, such as a house or car.
7、Carry your Social Security card with you when entering the country.
8、Keep your Green Card valid and apply for a new one before the expiration date.
