On November 17, 2015, the U.S. Immigration Citizenship and Immigration Services Immigrant Investor Program Office (IPO) updated the latest data on EB-5 cases (as of September 30, 2015). Worldway now publishes and analyzes this data as follows:
Average processing time for I-526: 14.4 months, a continued slowdown from the previous 13.8 months.
Average processing time for I-829: 15.4 months, which is nearly the same as the previous 15.5 months.
Average processing time for I-924: 11.6 months, showing an improvement from the previous 12.3 months.
[Worldway Analysis] The most significant change in this case data is the continued slowdown in the review time for I-526. Under the current EB-5 policy change situation, projects that successfully submitted I-526 sample approvals before June 1, 2015, or projects that received I-526 sample approvals after June 1, 2015, may be protected by the grandfathering rule and not be affected by price increases, changes in TEA areas, and other factors, effectively responding to the policy changes of December 11.
Worldway's three major EB-5 projects, which are exclusively represented by us — the DLJ Four Seasons Hotel Resort Project and the Columbus 90 Apartment Project, are the best choices to respond to the December 11 policy changes. This is because all three projects are grandfathered, and their investment amounts, TEA designations, and job calculation methods are not affected by the new policies.
Additionally, among these three projects, the DLJ Four Seasons Hotel Project received sample pre-approval in March of this year, and the investors' I-526 applications have also been approved; the Columbus 90 Project received sample pre-approval in May of this year, so after December 11, the I-526 continuous approvals for investors in these two projects will not be affected.
Of course, in addition to being protected by the grandfathering rule and continuing to enjoy the favorable policy of the last $500,000 investment, Worldway's three high-quality projects also have many advantages such as ample job creation, strong developers, good exit mechanisms, and low investment and repayment risks. Each project also has its own unique advantages, and it is precisely because they possess many concentrated advantages that they become a rare and optimal choice for successfully seizing the last opportunity for U.S. immigration before the December 11 policy changes.
