On August 28, the official website of the U.S. Immigration agency released the latest data on EB-5 case filings and approvals for the third quarter of fiscal year 2015 (April 1 to June 30, 2015). Worldway now organizes and summarizes the latest data as follows:
I-526 Immigrant Petition: As of the third quarter of 2015, there were 13,117 pending applications. USCIS significantly accelerated the approval speed of I-526 in the third quarter, approving a total of 3,125 applications. At this rate, it will still take 12.6 months to clear the remaining pending I-526 applications.
I-829 Petition to Remove Conditions: As of the third quarter of 2015, there were 4,007 pending applications.
2005-2015 I-526 and I-829 Approval Rate Reference:
[Worldway Authoritative Interpretation] The approval rates for I-526 and I-829 this quarter have remained stable at a high level. However, as of the third quarter of 2015, there were 13,117 pending I-526 immigrant petitions. This indicates that the current visa backlog and processing delays remain severe. Furthermore, Charles Oppenheim, Chief of the Visa Control and Reporting Division at the U.S. Department of State, announced that the EB-5 visa backlog for China will gradually extend from 2 years to 2.5 years in fiscal year 2016! This means the backlog will only continue to grow, and investors should act decisively and early. On one hand, investing early in projects protected by the grandfather clause that have also received exemplar approval from USCIS can help avoid the impact of policy changes and price increases on projects and investment activities. On the other hand, one must race against time; filing a day earlier means being approved a day earlier, catching the last train before policy changes, and joining the U.S. immigrant visa backlog queue a day earlier.

Seize the final spots for high-quality projects that have already received USCIS exemplar approval and are protected by the grandfather clause (group buying ends on September 30)—the DLJ Four Seasons Hotel and Resort project (a project invested by the DLJ multi-billion fund that has received I-526 exemplar approval) and the Pennsylvania Turnpike project (a government-backed repayment project that has received I-924 actual project exemplar approval).
