1. U.S. Citizenship and Immigration Services Has the Authority to Implement the EB-5 Price Increase Without Congressional Approval
The EB-5 Act implemented in 1991 granted U.S. Citizenship and Immigration Services the authority to independently implement and enforce price increases. This means that to raise the minimum investment amount for EB-5 to reflect U.S. inflation, U.S. Citizenship and Immigration Services does not need Congressional approval and can execute the authority granted by regulations to increase the minimum investment amount.
Especially with the recent notification from the U.S. Department of Homeland Security, which requires U.S. Immigration to execute the authority granted by regulations to increase the EB-5 minimum investment amount, this further confirms their firm determination to increase the EB-5 price!
2. There is Uncertainty Regarding Whether the New Trump Administration Will Endorse This Proposal
