Project Introduction
EB-1A Immigration Program
EB-1A is an immigration application category designed for individuals of extraordinary ability, classified under the first preference category for employment-based immigration; it requires applicants to demonstrate extraordinary ability in the fields of science, arts, education, business, or athletics, and to possess national or international acclaim, with their achievements and contributions recognized broadly in their field. This category does not require employer sponsorship and allows applicants to submit immigration applications without an employer initiating a labor certification, enabling the entire family to receive green cards at once.
NIW Immigration Program
The National Interest Waiver (NIW) is a special category under the second preference (EB-2) for employment-based immigration in U.S. immigration law. While the EB-2 category typically requires a labor certification, the U.S. government waives this requirement for certain foreign nationals who make significant contributions to the national interest of the United States, allowing them to directly submit their immigration applications.
National Interest Waiver:
- The professional field engaged by the applicant has substantial value
- The applicant has certain contributions and achievements in their professional field
- The applicant's relinquishment of job opportunities would bring national benefit to the U.S.
